- The Office of Acquisition and Agreement Management (OAAM), of the National Institute of Standards and Technology (NIST), on behalf of the Material Measurement Laboratory (MML), intends to negotiate on a sole-source basis with Bruker AXS, Inc., under the authority of 41 US 3304 (a)(1), for repair and maintenance services for a Bruker Quantax Silicon Drift X-Ray Detector (Nano XFlash Detector 5040; S/N 3250). The service contract shall be for a base period of one year with three one-year option periods. The Microanalysis Research Group (MRG) of the MML at NIST performs morphological and compositional research at the micrometer and nanometer scale using an assortment of complementary electron beam, ion beam, and X-ray tools and techniques. One such tool, an electron probe microanalysis instrument featuring a Bruker Quantax Silicon Drift X-ray Detector, supports this research mission. The MRG requires a service contract for the instrument so that the instrument may continue to operate without extended interruption and achieve its optimal performance. Sole source determination is based on the following: Bruker AXS Inc. has proprietary knowledge of all-up-to-date service practices and techniques required to keep the instrument operating in accordance with the manufacturer's specifications. Bruker has no authorized resellers or service providers. Therefore, only Bruker can supply the required service and guarantee that the maintenance and parts will be fully compatible with the equipment, and meet the original manufacturer's specifications. In addition, the instrument's software updates, service and use manuals, and schematics are proprietary to Bruker and are not available on-line to the general public. The North American Classification System (NAICS) code for this acquisition is 811219 - Other Electronic and Precision Equipment Repair and Maintenance. The small business size standard is $20.5M. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, responses received by 4:00 p.m. Eastern Time on July 14, 2015 will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
