Description

This is a combined synopsis/solicitation for commercial items prepared in accordance with the Federal Acquisition Regulation (FAR) format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The government intends to issue a Purchase Order in accordance with FAR PART 13.106 for the requirement under Simplified Acquisition Procedures. The solicitation number is 1151875 and this solicitation is issued as a Request for Quote (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-82 effective June 8, 2015. The associated North American Industry Classification System (NAICS) Code is 334516 ‐ Analytical Laboratory Instrument Manufacturing. FSC Code is 6640. Small Business Size Standard is 500 employees. Acquisition is unrestricted. Contract Type: Commercial Item-Firm Fixed Price. REQUIREMENTS: The Food and Drug Administration (FDA), National Center for Toxicological Research (NCTR), Division of Biochemical Toxicology has a requirement for 1 each - benchtop flow cytometer to include inside delivery, onsite installation, set-up, onsite training and post-warranty maintenance for up to four (4) 1-year option periods for use in an upcoming ovarian cancer study that will require the use of a flow cytometer to examine the cell kinetics (cell cycle, necrosis/apoptosis, proliferation). Minimum General Specifications: The flow cytometer shall be delivered with all necessary supplies, equipment, components, pumps, samplers, columns, detectors, adapters, software, instrument computers, drivers, accessories, etc. required to seamlessly install, set-up, test and train; Contractor is responsible for a turnkey solution. The system shall be a newly manufactured, not used, refurbished, or previously used for demonstration. The entire system shall be warranted for a minimum of one (1) calendar year from date of acceptance. All standard information pertaining to the equipment, including but not limited to User Manuals, Operation and Maintenance (O&M) Manuals, Material and Safety Data Sheets (MSDS), troubleshooting guides and any other applicable documentation, shall be provided upon installation of the system. The system shall have at least two-lasers (blue/red laser) with expandability to add at least 2 more lasers at a later date. The system shall provide the capability of reading the following fluorochromes: FITC, PE/PT, APC, APC-CY7, PC5, PC5.5, PerCP, PerCP-Cy5.5, and PI. The system shall be capable of reading multiple dyes in one run and in combination without channel overlap (dye bleeding). The system shall process samples at sample flow rates up to at least 200 μL per minute without loss of resolution or sensitivity. System shall be able to receive at a minimum 1.5 and 2.0mL micro centrifuge tubes and 5.0mL and standard U-, V- and Flat bottom plates. Minimum sample volume required shall be 50 µL for the single tube format. System shall provide some method of eliminating background noise and debris. The system shall be in a format in which the optical system is fixed, thus it should not require adjustment of the optical system. The software shall allow both acquisition and analysis of data and be available for use on any computer with unlimited licenses. The system shall not require any special electrical or environmental conditions beyond those normally found in a standard laboratory environment. The system shall have a minimum fluorescence sensitivity range of <30 MESF for FITC and <10 MESF for PE. To keep disposal of fluid waste to a minimum and increase cost effectiveness, the system's normal fluid consumption shall not be greater than 250 ml/hr for an 8 hour day. Instrument fluid containers shall be contained within in the system and not require any separate containment units. The system shall have manual sampling capabilities. Minimum Onsite Installation, Set-Up, Testing and Onsite Training The Contractor shall provide all labor, travel, and tools to install the equipment at the address provided below, to include inside delivery. Equipment shall be tested once installed to verify all aspects of the system are operating within parameters of the required specifications. The vendor shall demonstrate upon installation and testing that the item meets all performance specifications. Upon acceptance, the Contractor shall provide onsite, comprehensive training to users to include, but not be limited to, operational procedures, operator maintenance, method building, date interpretation, and simple trouble shooting. Minimum Annual Post-Warranty Service Requirements: Shall include at least one (1) planned, onsite preventative maintenance visit per contract year. Shall include unlimited technical support of contact for assistance (e.g., telephone-based, email-based, website-based, etc.) and unlimited corrective/remedial maintenance visits for service, Mondays - Fridays (excluding Federal Holidays) between the hours of 7:00 AM - 5:00 PM Central Standard Time (CST). Shall include unlimited software and firmware updates. All maintenance and repair activities shall be performed by formally trained and certified technicians/engineers, following Original Equipment Manufacturer (OEM) specifications, manuals, and service bulletins, using ne OEM replacement parts, components, subassemblies, etc. All maintenance pricing shall be inclusive of labor, travel, replacement parts, components, subassemblies, etc. Service Records and Reports - The Contractor shall, commensurate with the completion of each service call (inclusive of warranty service), provide the end-user of the equipment with a copy of a field service report/ticket identifying the equipment name, manufacturer, model number, and serial number of the equipment being serviced/repaired and detailing the reason for the service call, a detailed description of the work performed, the test instruments or other equipment used to affect the repair or otherwise perform the service, the name(s) and contact information of the technician who performed the repair/service, and for information purposes, the on-site hours expended and parts/components replaced. In addition, the Contractor shall provide a written report to the FDA COR and Contract Specialist, summarizing all maintenance and repair activities (including warranty work) each time service and/or repair is performed. Additional Offer Submission Instructions The government is not responsible for locating or securing any information, which is not identified in the offer. To ensure information is available, offerors shall furnish as part of their quote all descriptive material necessary for the government to unequivocally determine the equipment offered meets or exceeds the technical requirements, and the system will absolutely support FDA's stated need. The quote shall provide information on any turn-key solutions to meet the intended application, inclusive of all necessary supplies, equipment, components, pumps, samplers, columns, detectors, adapters, software, instrument computers, drivers, accessories, etc. All proprietary information shall be clearly marked. Offeror shall include a price breakout for all components within Item No. 0001's extended total, to include detailed description, catalog/part number, quantity, and unit price of each accessory or ancillary item to the system. Any items offered on GSA Contract shall be indicated on offer as such. The post-warranty maintenance periods will not be funded at point of equipment purchase. If exercised, funding will be obligated individually each year for the option period exercised via contract modification; the option periods shall be priced accordingly. The period of performance for the option periods in any resultant award will be estimated based on the date of award, estimated ultimate delivery of Item No. 0001, and applicable warranty period. If/when Option Period 1 is exercised, the periods of performance for all options will be firmed via modification. Prices provided shall be valid through September 30, 2015. Award subject to availability of funds. Price quotes shall be F.O.B. destination inclusive of shipping & handling expenses. Service Contract Act Exemption This solicitation is being issued under the premise that the Contractor will certify that the post-warranty maintenance services are exempt from the Service Contract Act per the conditions set forth in FAR 52.222-48 & FAR 22.1003-4(c). If this is the case and the Contractor certifies that is exempt under the terms and conditions of 52.222-48, then clause 52.222-51 will flow per usual from this solicitation to the resulting order. (i) An "established catalog price" is a price included in a catalog, price list, schedule, or other form that is regularly maintained by the manufacturer or the offeror, is either published or otherwise available for inspection by customers, and states prices at which sales currently, or were last, made to a significant number of buyers constituting the general public. (ii) An "established market price" is a current price, established in the usual course of trade between buyers and sellers free to bargain, which can be substantiated from sources independent of the manufacturer or offeror; and (3) The compensation (wage and fringe benefits) plan for all service employees performing work under the contract are the same as that used for these employees and equivalent employees servicing the same equipment of commercial customers. (b) Certification by the offeror as to its compliance with respect to the contract also constitutes its certification as to compliance by its subcontractor if it subcontracts out the exempt services. If the offeror certifies to the conditions in paragraph (a) of this provision, and the Contracting Officer determines in accordance with FAR 22.1003-4(c)(3) that the Service Contract Act- (1) Will not apply to this offeror, then the Service Contract Act of 1965 clause in this solicitation will not be included in any resultant contract to this offeror; or (2) Will apply to this offeror, then the clause at 52.222-51, Exemption from Application of the Service Contract Act to Contracts for Maintenance, Calibration, or Repair of Certain Equipment--Requirements, in this solicitation will not be included in any resultant contract awarded to this offeror, and the offeror may be provided an opportunity to submit a new offer on that basis. (d) The Contracting Officer may not make an award to the offeror, if the offeror fails to execute the certification in paragraph (a) of this provision or to contact the Contracting Officer as required in paragraph (c) of this provision. The specific evaluation criteria to be included in paragraph (a) of that provision are as follows: (i) technical acceptability; (ii) price The Government will award an order resulting from this solicitation to the lowest priced technically acceptable responsible offeror. Offers will be evaluated on their ability to meet the minimum technical requirements. The lowest priced quote will be evaluated first. If the lowest priced quote is not technically acceptable, the next lowest priced quote will be evaluated and so on until a technically acceptable quote is determined. (d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract.
