Description
JUSTIFICATION FOR SINGLE SOURCE AWARDS IAW FAR 13.106-1 (OVER MICRO-PURCHASE THRESHOLD($3K) BUT NOT EXCEEDING THE SAT ($150K)) IAW FAR13.104, COs must promote competition to the maximum extent practicable to obtain supplies and services from the source whose offer is the most advantageous to the Government, considering the administrative cost of the purchase. When competition is not practicable, IAW FAR13.106-1(b), COs solicit from a single source for purchases not exceeding the simplified acquisition threshold. COs may solicit from one source if the CO determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). IAW FAR13.106-3(b)(3),COs are required to include additional statements explaining the absence of competition (see 13.106-1 for brand name purchases) if only one source is solicited and the acquisition does not exceed the simplified acquisition threshold (does not apply to an acquisition of utility services available from only one source) or supporting the award decision if other than price-related factors were considered in selecting the supplier. This template when completed can be used to document single source awards IAW FAR13.106-3(b)(3). Note: Statements such as "only known source" or "only source which can meet the required delivery date" are inadequate to support a sole source purchase. 1. PURCHASE REQUEST OR REQUISITION NUMBER: 664-15-3-196-0126 1A. PROJECT/TASK NUMBER 1B. ESTIMATED AMOUNT: $75,223.00 1.2. BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE: Request the continued purchase of the current contract with SD Pathologists for all immunohistochemical (IHC) staining. The contract is essential to ensure the continued effectiveness of patient testing in an effort to obtain particular patient results not currently available through VASDHCS Pathology & Laboratory Medicine Service. This purchase will aid in the continuation of exemplary patient care by preventing a lag in testing due to a deficiency in not having the availability of external consultation should the need arise. At this time no other contractor has the same staining range immunohistochemical (IHC) stains. The Contractor is located in San Diego the immunohistochemical (IHC) staining, so they are able to provide the 24-hour turnaround time frame required. 2.3. UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED: The VA San Diego Healthcare System (VASDHS) Pathology and Laboratory Medicine Service (PALMS) requires the use of a single laboratory for all immunohistochemical (IHC) staining (stain only, no interpretation) with a 24-hour turnaround time. In order to make timely pathology diagnoses, immunohistochemical stain results need to be available within one day (24 hour) period. Stains provided by San Diego Pathology are used to aid in diagnosis of cancer, infectious disease, and AIDS, so the patients can be appropriately treated immediately without delay in patient care. Since VA San Diego PALMS does not have an in house immunochemistical lab, this service has to be purchased from a vendor that can provide comparable service with the required 24-hour turnaround time. An inquiry was made to identify labs with a 24-hour turnaround time. There are no other pathology labs in the San Diego area with the breadth of antibody menu AND meet the 24-hour turnaround time requirement. 4. REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE, WHICH CAN PROVIDE THE SUPPLIES OR SERVICES: Many of the reference laboratories including Quest Diagnostics Laboratory offer immunohistochemical stain services but the turnaround time is approximately one week or longer due to the time of shipping to reference labs, which is not acceptable for standard of care pathology service. Due to the time required to ship to other sites, sending the pathology tissue blocks to another VA that has an in house immunohistochemical lab is not feasible and cannot be turned around in 24 hours. Academic affiliate University hospital laboratory does not have the excess capacity to perform stains for VA San Diego Healthcare System. 5. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND RESULTS OR STATEMENT WHY IT WAS NOT CONDUCTED: A market research was conducted on the internet and via internal systems in connection with this interim. No other contractor that provides this service are able to provide this service within 24-hour. Due to fact that San Diego Pathology is only company that can provide this service at this time. 6. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b).
