- FAR 52.203-98 FAR 52.212-5 FAR 52.203-99 This notice is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6 "Streamlined Procedures for Evaluation and Solicitation for Commercial Items," as applicable, and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation document will not be issued. Submit offers on RFQ-RML-C-1744329. This solicitation is a request for quotes (RFQ).The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 05-82 May 7, 2015. The associated North American Industry Classification System (NAICS) code for this procurement is 325414 with a small business size standard of 500 personnel. This is not a total small business set aside. Cage Code: 1F3R7 The National Institute of Allergy and Infectious Diseases (NIAID), Rocky Mountain Laboratories, is seeking to purchase US origin Certified Fetal Bovine Serum on a brand name basis. This specific FBS, manufactured through Life Technologies, is rigorously tested for performance standards, which is critical to the Laboratory of Virology's work. In addition, this FBS is useful for a broad range of cell types and has low endotoxin levels, which is important for avoiding non-specific effects during experiments. The quality of this FBS has been tested in past years and determined to be a robust supplement for growing virus stocks and maintaining cell cultures. The Laboratory of Virology is requesting specific lot # 1698221. All interested companies shall provide quotation(s) for this particular fetal bovine serum: •Fetal Bovine Serum, certified, US origin, 500 ml, Quantity 80 each •Item # 16000-044 •The manufacturer is Life Technologies. •Lot # 1698221 FOB point shall be Destination; Hamilton, MT. Place of Performance: Rocky Mountain Laboratory National Institute of Health 903 South 4th Street Hamilton, MT 59840 United States. Award will be based on the capability of the item offered to meet the above stated salient characteristics, price, past performance, delivery, warranty and the best value to the government. The following FAR provisions apply to this acquisition: 52.212-1 Instructions to Offerors Commercial Items (April 2014) FAR 52.212-3 Offerors Representations and Certifications - Commercial Items (March 2015) Offerors must complete annual representations and certifications on-line at http://www.sam.gov in accordance with FAR 52.212-3 Offerors Representations and Certifications- Commercial Items The following contract clauses apply to this acquisition: FAR 52-212-4 Contract Terms and Conditions Commercial Items (May 2014) FAR 52-212.5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items (May 2015) The applicable subparagraphs of FAR52.212-5 are included in the attachment to this posting. 52.209-2 -- Prohibition on Contracting with Inverted Domestic Corporations--Representation. (Dec 2014) (a) Definitions. "Inverted domestic corporation" and "subsidiary" have the meaning given in the clause of this contract entitled Prohibition on Contracting with Inverted Domestic Corporations (52.209-10). (b) Government agencies are not permitted to use appropriated (or otherwise made available) funds for contracts with either an inverted domestic corporation, or a subsidiary of an inverted domestic corporation, unless the exception at 9.108-2(b) applies or the requirement is waived in accordance with the procedures at 9.108-4. (c) Representation. The government intends to award a purchase order as a result of this solicitation that will include the terms and conditions set forth herein. To facilitate the award process all quotes must include a statement regarding the terms and conditions herein as follows: "The Terms and conditions in the solicitation are acceptable to be included in the award document without modification, deletion or addition." OR "The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:" (Quoter shall list exception(s) and rationale for the exception(s).)
