- Sole Source Justification for 3 day Cargo Tank Training 3 day Cargo Tank Training Statement of Work Notice of Intent to award a sole source for a 3 day Cargo Tank Training NOTICE OF INTENT- To Award a Sole Source Procurement This is a notice of intent by the Federal Motor Carrier Safety Administration (FMCSA) to award a new sole source contract to The National Board of Boiler and Pressure Vessel Inspectors, Inc., at 1055 Crupper Avenue, Columbus, Ohio 43229-1183. Contract Number: DTMC75-15-C-00018 Contract Dollar Value: $29,430.00 North American Industry Classification System (NAICS) Code: 611430, Professional and Management Development Training Period of Performance: 3 days of training To Be Determined (TBD) The purpose of this contract is to obtain unique training from the National Board of Boiler and Pressure Vessel Inspectors, Inc. The National Board of Boiler and Pressure Vessel Inspectors is responsible for defining the codes enforced by the Federal Motor Carrier Safety Administration/(FMCSA) as it relates to the national and international highway transportation of hazardous materials. FMCSA has previously received this training from the National Board, but due to the mission-critical and Agency-focused needs to ensure compliance of the vast population of cargo tank motor vehicles used to transport hazardous materials, combined with turn-over of FMCSA staff, the need for refresher training has been identified. The increase in domestic oil production in the United States has raised concern over safety issues relating to the transportation of this material and the supporting materials by highway and rail. Because of these concerns, Congress has provided additional funding to the FMCSA to increase its enforcement in this area, which requires a broad knowledge of the ASME code by its investigative staff. FMCSA is in need of training specifically on requirements from the 1998 edition of the ASME code. This need is based on the fact that this is the only edition officially recognized by the U. S. Department of Transportation (DOT) and incorporated by reference into 49 CFR part 171 section 171.7. At this time, only the National Board of Boiler and Pressure Vessel Inspectors has the training curriculum on the 1998 requirements available. The National Board is therefore responsible for providing all of the training materials and equipment through an on-site and hands-on training medium that deals with the manufacturing, operation, maintenance, repair, and alteration process in ensuring compliance of pressurized bulk packaging. The contemplated contract will be firm fixed-price. This award will be made in accordance with FAR Part 6.302-2. Only one responsible source is capable of satisfying agency requirements and unusual and compelling urgency. These services are highly specialized and can be provided by a single source, The National Board of Boiler and Pressure Vessel Inspectors, Inc., due to urgent and compelling circumstances. Based on research, FMCSA believes that there is only one valuable source capable of meeting the Agency's urgent and compelling need to ensure that the required training is available to Agency personnel. Due to mission critical Agency needs, it is in FMCSA's best interest to ensure compliance of the vast population of cargo tank motor vehicles used to transport hazardous materials. A potential risk may potentially impact the safety of the agency if another source would have to develop the required specialized training due to transitional time and costs.
