- INTRODUCTION This is a pre-solicitation non-competitive (notice of intent) synopsis to award a contract without providing for full or open competition (including brand-name). THIS IS A NOTICE OF INTENT, NOT A REQUEST FOR PROPOSAL. A SOLICITATION WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. The National Institute on Drug Abuse (NIDA), Consolidated Station Support and Simplified Acquisitions (CSS/SA) Branch intends to negotiate and award a purchase order to Newport Corporation/Spectra Physics Lasers Division for maintenance support for two (2) Mai Tai HS DS Lasers without providing for full and open competition (including brand-name). NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 811310 with a Size Standard of $14 Million. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-83 dated July 2, 2015. This acquisition is for a commercial item or service and is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures. This acquisition is NOT expected to exceed the simplified acquisition threshold. STATUTORY AUTHORITY This acquisition is conducted under the authority of the authority of FAR Subpart 13.106-1. DESCRIPTION OF REQUIREMENT Background: The National Institute of Neurological Disorders and Stroke (NINDS) is a part of the NIH, and conducts research into the causes, treatment, and prevention of neurological disorders and stroke. The NINDS mission is to seek fundamental knowledge about the brain and nervous system and to use that knowledge to reduce the burden of neurological disease. The NINDS Viral Immunology and Intravital Imaging Section (VIIIS) owns two Mai Tai HS DS Lasers which are manufactured by and proprietary to the Newport Corporation Spectra-Physics Laser Division. The Mai Tai HS DS Lasers are used for ongoing NINDS research studies and require regular maintenance support to ensure continued full function. Purpose and Objectives The purpose of this acquisition is to acquire maintenance services to support two Mai Tai HS DS Lasers owned by the NINDS VIIIS. To ensure standardization of research data and continuation of equipment warranties, maintenance may only be performed by the original equipment manufacturer, Newport Corporation Spectra-Physics Laser Division. Project Description The Contractor shall provide all labor, travel, and parts necessary to perform on-site maintenance for two (2) Mai Tai HS DS Lasers (System Serial Nos. 3375 and 4627). The laser care services for both systems shall be performed at the Gold Service Level. Period of Performance The period of performance for this requirement is 08/14/2015 - 08/13/2016 plus three (3) one-year option periods. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted. Specifically, only Newport Corporation/Spectra Physics Laser Division is capable of providing the necessary maintenance support service because the equipment requiring maintenance is proprietary to this company, the original equipment manufacturer. As such, only Newport Corporation/Spectra-Physics Laser Division is authorized to provide service and parts for the equipment requiring maintenance. Use of any other contractor would place equipment integrity in jeopardy which would then risk continuity of science; should the equipment not remain fully functional to original equipment manufacturer standards, standardization of NINDS longitudinal research study data would be jeopardized and any loss of this data would be to the serious detriment of the NINDS mission. Accordingly, only Newport Corporation/Spectra-Physics Laser Division is capable of providing the required maintenance support services. CLOSING STATEMENT THIS SYNOPSIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by the closing date and time of this announcement and must reference the solicitation number.
