AMENDMENT NOTICE:This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice.The solicitation number is 40220069 and is issued as an invitation for bids (IFB), unless otherwise indicated herein.The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-82. The associated North American Industrial Classification System (NAICS) code for this procurement is 326199 with a small business size standard of 750.00 employees.This requirement is a [ Small Business ] set-aside and only qualified offerors may submit bids.The solicitation pricing on www.FedBid.com will start on the date this solicitation is posted and will end on 2015-07-16 17:00:00.0 Eastern Time or as otherwise displayed at www.FedBid.com.FOB Destination shall be in the Special Shipping Instructions. The DOI BLM New Mexico State Office requires the following items, Meet or Exceed, to the following: LI 001: Fiberglass Water Storage Tank 12,000 gallon delivered in accordance with attached specifications and delivery requirements, 3, EA; Solicitation and Buy Attachments ***Question Submission: Interested offerors must submit any questions concerning the solicitation at the earliest time possible to enable the Buyer to respond. Questions must be submitted by using the 'Submit a Question' feature at www.fedbid.com. Questions not received within a reasonable time prior to close of the solicitation may not be considered.*** For this solicitation, DOI BLM New Mexico State Office intends to conduct an online competitive reverse auction to be facilitated by the third-party reverse auction provider, FedBid, Inc. FedBid has developed an online, anonymous, browser based application to conduct the reverse auction. An Offeror may submit a series of pricing bids, which descend in price during the specified period of time for the aforementioned reverse auction. DOI BLM New Mexico State Office is taking this action in an effort to improve both vendor access and awareness of requests and the agency's ability to gather multiple, competed, real-time bids.All responsible Offerors that respond to this solicitation MUST submit the pricing portion of their bid using the online exchange located at www.FedBid.com. There is no cost to register, review procurement data or make a bid on www.FedBid.com.Offerors that are not currently registered to use www.FedBid.com should proceed to www.FedBid.com to complete their free registration. Failure to comply with the below terms and conditions may result in offer being determined as non-responsive. New Equipment ONLY; NO remanufactured or "gray market" items. All items must be covered by the manufacturer's warranty. Bid MUST be good for 30 calendar days after close of Buy. Shipping must be free on board (FOB) destination CONUS (Continental U.S.), which means that the seller must deliver the goods on its conveyance at the destination specified by the buyer, and the seller is responsible for the cost of shipping and risk of loss prior to actual delivery at the specified destination. This solicitation requires registration with the System for Award Management (SAM) prior to award, pursuant to applicable regulations and guidelines. The selected Offeror must comply with the following commercial item terms and conditions, which are incorporated herein by reference: FAR 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition; FAR 52.212-3, Offeror Representations and Certifications - Commercial Items - the selected offeror must submit a completed copy of the listed representations and certifications; FAR 52.212-4, Contract Terms and Conditions - Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, paragraph (a) and the following clauses in paragraph (b): 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.225-13, 52.232-34. The full text of the referenced FAR clauses may be accessed electronically at https://www.acquisition.gov/far/. The Government desires delivery to be made according to the following schedule: DESIRED DELIVERY SCHEDULE- ALL ITEMS DELIVERED WITHIN 60 DAYS AFTER DATE OF CONTRACT If the offeror is unable to meet the desired delivery schedule, it may, without prejudicing evaluation of its offer, propose a delivery schedule below. However, the offeror?s proposed delivery schedule must not extend the delivery period beyond the time for delivery in the Government?s required delivery schedule as follows: REQUIRED DELIVERY SCHEDULE-ALL ITEMS DELIVERED WITHIN 90 DAYS AFTER DATE OF CONTRACT Offers that propose delivery of a quantity under such terms or conditions that delivery will not clearly fall within the applicable required delivery period specified above, will be considered nonresponsive and rejected. If the offeror proposes no other delivery schedule, the desired delivery schedule above will apply. OFFEROR?S PROPOSED DELIVERY SCHEDULE--PLEASE UPLOAD PROPOSED DELIVERY SCHEDULE (b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed or otherwise furnished to the successful offeror results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day the award is dated. Therefore, the offeror shall compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor?s date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term ?working day? excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected. (End of Clause) Question from vendor: Will alternate tank materials such as steel be accepted? Answer: No steel is not what we were hoping for. Because of the very caustic water in the pipeline system, steel tanks do not last in this location and the livestock grazing permittee has specifically requested fiberglass. Question:Above or below ground Answer: The tanks will be above ground Question: Can you please confirm if the delivery site has the capabilities to offload the tank from the delivery truck Answer: Delivery Location is off of US Hwy 380 (two lane US Hwy with shoulders) as indicated on the maps. The truck has to cross a cattle-guard or gate that is locked (must arrange for access), I am guessing 14 to 16 foot width gate and/or cattle-guard. Vendor is responsible for off-loading without damage to the tanks. 1) Is a post-cure required, since it is a potable water tank? The Specs say "Potable water construction style" implying one piece tank not delivered in pieces and assembled onsite, the tanks do not have to be certified for potable water, this is for a livestock water system. Post-curing was not itemized in the specs, but it is typically part of proper tank manufacturing of single piece filament wound construction it needs to occur to ensure structural integrity of the tanks. Again these are only intended for water, however, the water quality is so poor fiberglass was selected over other tank materials. 2) Is a 100 mil corrosion liner required? No liner separate of the tank construction of fiberglass is required, again this does not have to be certified for potable water. 3) Is the manway on the top or the side? Preferably located on the side (but not mandatory on the side in the specs), because of the height of the upright construction (dimensions) a side access is more practical and safe. 4) Shall the tanks be designed for wind and Seismic loads? Yes, that was part of the reasoning behind requiring three eyebolt tie downs for anchoring on the top. 5) Shall the fabrication be ASME RTP-1 certified? No, the fabrication does not need to be ASME RTP-1 certified, per the specs. Additional corrosion protection is not necessary. Again these are only intended for water, however, the water quality is so poor fiberglass was selected over other tank materials. 6) Are top ribs required, and if so must they be designed per ASTM 3299/4097? Top ribs were included in specs due to market research indicating that was common practice in fabrication. Also allows for strength in lifting and tie-down anchoring for wind. 7) What warranties are required by the manufacturer? Minimum required 1 year manufactures warranty. 8) If bidder is not the OEM, what warranty bonds are required to ensure warranty coverage? Minimum required 1 year manufactures warranty.
