- PhishME Combined Syn Sol FBO (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) The solicitation number is OS155515. The solicitation is issued as a Request for Quote (RFQ). (iii) This solicitation and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-81. (iv) The corresponding NAICS code is 511210 and the small business size standard is $38.50 million. (v) List of contract line item number(s) and items, quantities and units of measure - Contract Line Item (CLIN): 1 Description: Purchase of PhishMe License for 11,000 Recipients Licensed on an Annual Basis as a Software-as-a-Service Solution (SaaS) Includes Unlimited Use, PhishMe Reporter, Domain Management, Support and Program Development, Managed Services Development-Light and Unlimited Basic Product Support Quantity: 12 months (award shall be no late than 9/30/2015) (vi) Description of Requirements - see section (v) (vii) Delivery shall be provided FOB Destination to Washington, DC no later than 9/30/2015. The period of performance shall begin no later then 9/30/2015 and continue for twelve (12) months. (viii) The provision at FAR 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition. (ix) The provision at FAR 52.212-2, Evaluation - Commercial Items, applies to this acquisition. The Government will award a contract resulting from this synopsis/solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. (x) Offerors are to include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items, with its offer or acknowledge its listing in Online Representations and Certifications Application (ORCA). (xi) The clause at FAR 52.212-4, Contract Terms and Conditions - Commercial Items, applies to this acquisition. (xii) The clauses at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items applies to this acquisition. (xiii) The clauses at HHSAR 352.203-70, Anti-Lobbying; HHSAR 352.222-70, Contractor Cooperation in Equal Employment Opportunity Investigations; HHSAR 352.231-70, Salary Rate Limitation, apply to this acquisition. (xiv) Sole Source Justification- Pursuant to FAR 13.106-1(b), the Department of Health and Human Services (HHS), Program Support Center (PSC), Acquisition Management Services (AMS), on behalf of the Office of the Chief Information Officer (OCIO) intends to negotiate and award a purchase order on a sole source basis to PhishMe, Inc. for the purchase of PhishMe licenses. PhishMe, Inc., makers of PhishMe licenses, is the only distributor of PhishMe licenses. There are no other vendors authorized to sell these licenses. PhishMe, Inc. not only creates the software but PhishMe, Inc. sells, maintains and supports every customer of the system. (xv) DPAS - N/A (xvi) Offers are due on July 15, 2015 by 6:00 PM Eastern Standard Time, electronically to the Contract Specialist at Daren.Davis@psc.hhs.gov.
