Description

JUSTIFICATION FOR SINGLE SOURCE AWARDS IAW FAR 13.106-1 (OVER MICRO-PURCHASE THRESHOLD($3K) BUT NOT EXCEEDING THE SAT ($150K)) IAW FAR13.104, COs must promote competition to the maximum extent practicable to obtain supplies and services from the source whose offer is the most advantageous to the Government, considering the administrative cost of the purchase. When competition is not practicable, IAW FAR13.106-1(b), COs solicit from a single source for purchases not exceeding the simplified acquisition threshold. COs may solicit from one source if the CO determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). IAW FAR13.106-3(b)(3),COs are required to include additional statements explaining the absence of competition (see 13.106-1 for brand name purchases) if only one source is solicited and the acquisition does not exceed the simplified acquisition threshold (does not apply to an acquisition of utility services available from only one source) or supporting the award decision if other than price-related factors were considered in selecting the supplier. This template when completed can be used to document single source awards IAW FAR13.106-3(b)(3). Note: Statements such as "only known source" or "only source which can meet the required delivery date" are inadequate to support a sole source purchase. 1. PURCHASE REQUEST OR REQUISITION NUMBER: 672-15-3-039-05441A. PROJECT/TASK NUMBER 1B. ESTIMATED AMOUNT: $5,922.00 2. BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE: The Thin Prep Kit includes: five hundred (500) TransCyt Filter Kits; five (5) trays of one hundred (100) filters; five hundred (500) Thin Prep Slide Kits; two hundred and fifty (250) PreservCyt Vials; five hundred (500) device sets of Medscand Cytobrush/Spatula Kit. This item has diagnostic capability and unique components for comprehensive and accurate cervical cancer testing with the Thin Prep Processor 2000 equipment located at the Pathology Section. 3. UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED: The item must be compatible with the Thin Prep Processor 2000 and the Cervista System unit which is the equipment currently available at the Cytopathology Section. It offer several advantages over the conventional Pap Smear, including improved disease detection and testing for HPV, Chlamydia, and Gonorrhea straight from the vial providing the best tool to detect precancerous conditions and hidden small tumors that may lead to cervical cancer. The test is used to look for changes in the cells of the cervix and vagina that show cancer or conditions that may develop into cancer and, since the Pathology Section provides support to women veterans from Puerto Rico and the Virgin Islands, the acquisition of this item is vital and the purchase of a non-compatible item will interfere with the services offered to our patients in an adverse manner. The Thin Prep Pap Kit is the only item available that complies with all these requirements. The procurement of any other product, not compatible with Cervista could cause a waste of money. These commercial items cannot be modified and there are no other substitutes compatible with the technology used in the laboratory area. It is in the Government best interest to acquire this brand name product to be able to deliver optimal medical care to our female population. 4. REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE, WHICH CAN PROVIDE THE SUPPLIES OR SERVICES: The Thin Prep Kit is the only product that is compatible with the Thin Prep Processor 2000 and the Cervista System unit which is the equipment utilized in Cytopathology Lab and is essential to perform the cervical cancer screening test. Hologic has the unique capability to be the source to provide this item as stated in their letter of exclusivity which informs that they are the sole proprietary manufacturer and distributor of the Thin Prep. Also an examination of the acquisition history and experience with the marketplace under previous acquisitions was conducted. 5. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND RESULTS OR STATEMENT WHY IT WAS NOT CONDUCTED: After an extended market research thru NAC, GSA and internet we obtained only one responsible source. Accordingly, Hologic LP is the only firm capable of providing the Thin Prep Pap Test Kit without the VACHS experiencing substantial duplication of cost that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements 6. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b).
