- NOTICE OF INTENT TO NEGOTIATE A SOLE-SOURCE CONTRACT The United States Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Eastern Region Acquisition Division (ERAD), Simplified Acquisition Branch intends to negotiate on a sole source basis with Safe Software Inc., Suite 2017, 7445 - 132nd Street, Surrey, BC Canada V3W 1J8, using the procedures in FAR Part 8.406 and in accordance with Safe Software Inc. GSA contract GS-35F-0254T, to provide renewal of annual maintenance for SAFE-FME licenses and tools for a base year and two option periods. Safe Software, Inc. is the manufacturer of the Feature Manipulation Engine (FME) and SpatialDirect software packages. These packages are an industry standard for format conversion and distribution of geospatial data. They are used in mission critical applications such as the NOAA ENC Direct to GIS Web portal. NOAA's Office of Coast Survey currently has many different software licenses in use, and has a continuing requirement to access technical support and program updates for this essential software. This is to ensure that the software in use has the latest features and upgrades to support ongoing development work within the Office of Coast Survey. Updates are also needed to ensure that the software in use is up to date for compliance with IT security policies and is compatible with updates to computer operating systems. Without the purchase of the yearly support agreement, Coast Survey users would not have access to necessary updates and support for continued quality data processing and distribution. Furthermore, this software is used in conjunction with other ESRI software already purchased by this office to support GIS web applications. The statutory authority for other than full and open competition is FAR 8.405-6, only one source is capable of providing the services required. The North American Industry Classification Code (NAICS) for this acquisition is 511210 with a business size standard of $38.5 million. This is not a solicitation for competitive quotes. However, if any other interested party believes that it can meet the requirements, it may submit a statement of capabilities, which if timely received, will be considered by NOAA. A statement of capabilities must be received by 10:00 A.M. EDT, July 21, 2015. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. Evidence must be provided of ability to provide the required services. The capability statement and any other information furnished must be in writing and must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the requirements.
