INTRODUCTION: THIS IS A PRE-SOLICIATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPOSIS TO AWARD A PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). THIS IS A NOTICE OF INTENT, NOT A REQUEST FOR PROPOSAL. A SOLICITATION WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. The National Institute on Drug Abuse (NIDA), Station Support Contracts and Simplified Acquisitions Branch (SS/SA) on behalf of the National Center for Advancing Translational Services (NCATS) intends to negotiate and award a purchase order without providing for full and open competition (including brand-name) to Wako Automation USA, Inc at 11575 Sorrento Valley RD, Suite #207, San Diego, CA 92121for Kalypsys System Cell 3 Robot Replacement and Tox21 Hamamatsu Reader Integration. The solicitation number is HHS-NIH-NIDA-SSSA-2015-PSOL432 and the solicitation is issued as a pre-solicitation notice of intent to award on a sole-source basis. NORTH AERMICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE: The intended procurement is classified under NAICS code 334516 with a Size Standard of 500 employees. REGULATORY AUTHORITY: The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-83, dated July 2, 2015. This acquisition is conducted under the procedures as prescribed in FAR subpart 13.5-Test Program for Certain Commercial Items and FAR subpart 12-Acquisition of Commercial Items at an amount exceeding the simplified acquisition threshold ($150,000) and not exceeding $6.5 million. STATUTORY AUTHORITY: This acquisition is conducted under the authority of 41 U.S.C 3304(a)(1) under provisions of the statutory authority of FAR Subpart 6.302-1(a)(2)(i)(A)- Only one responsible source and no other supplies or services will satisfy agency requirements. DESCRIPTION OF REQUIREMENT: The National Center for Advancing Translational Services (NCATS) intends to procure, on a sole source basis, a Kalypsys System Cell 3 Robot replacement and Tox 21 Hamamatsu Reader Integration with Windows 7 upgrade. Background: Various programs and labs within NCATS have been given the directive to perform different types of high throughput screens to evaluate some biological activity and to potentially develop new therapeutics or therapeutic combinations in some cases or in others to determine the relative toxicity of chemical compounds under test. To do this, a biological experiment is performed in the presence of hundreds of thousands of chemical compounds at various concentrations, requiring that millions of samples be tested for each experiment. This requires that these experiments be run in a high density well plate, to both minimize the total reagent volume used per experiment and to facilitate less total plates to be used to perform an entire assay. Typically, one experiment might consist of screening 500,000 compounds at 5 different total concentrations for a total of 2.5M samples. If this experiment is run using a 1536 well plate, meaning 1536 samples can be tested at a time, this requires nearly 1650 plates. The only way to accomplish handling this many well plates for an experiment is high throughput screening (HTS), which requires a high degree of robotic automation. The two most active systems at the center are the Kalypsys Primary Screening system that was put into service in 2005 and the Tox21 Robotic Screening system that was put into service in 2007. As these systems increase in age, it becomes increasingly imperative that they can be maintained and supported. For this to happen, the systems must be comprised of parts from companies that are currently willing to support them. It is necessary to replace one of the Kalypsys system's robotic arms and the Tox21's current operating system must be upgraded. Purpose and Objectives: The purpose and objective of this requirement is to procure a Kalypsys System Cell 3 Robot replacement and Tox 21 Hamamatsu Reader Integration with Windows 7 upgrade. Deliverables/Period of Performance: This integration service will be performed within 12 weeks after receipt of order. 1.Description of Tasks and Associated Deliverables: •One integrated Hamamatsu plate reader onto the Tox21 HTS system •One modified EDC Bridge software application to leave the source plate unchanged when necessary •One personal computer with a Windows 7 operating system to operate the Tox21 HTS system. •One replacement robotic arm in cell 3 of the Kalypsys HTS system All "hard copy" deliverables will be submitted on recycled-content paper, and printed double-sided. 2. Reporting Requirements: The contractor is required to provide one written progress report at the conclusion of the service that shall cover all work completed during the specified period and shall present the work to be accomplished during the subsequent period. This report shall also identify any problems that arose and a statement explaining how the problem was resolved. This report shall also identify any problems that have arisen but have not been completely resolved and provide an explanation. Section 508 Program Need: Requirements for accessibility based on Section 508 of the Rehabilitation Act of 1973 (29 U.S.C. 794d) are determined to be relevant for the following program need: "Scientific Instrument." CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION: The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10-Market Research, specifically the review and evaluation of the responses to the sources sought notice published in the FedBizOpps on May 28, 2015, synopsis number HHS-NIH-NIDA-SSSA-SBSS-2015-432. This sources sought was posted on May 28, 2015 for the Kalypsys System Cell 3 Robot replacement and Tox 21 Hamamatsu Reader Integration with Windows 7 upgrade, for which were no responses as of the closing date, June 5, 2015. Due to the importance of upgrading NCATS existing systems in order to be appropriately maintained and supported, the systems must be comprised of parts and programs from companies that can currently support the existing systems. There are no other sources besides the proposed Contractor that can provide the requested requirements. Therefore, Wako Automation USA, Inc is the intended source for this award. CLOSING STATEMENT: This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to include ability to meet each of the project requirements, for which the party is able to provide, to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement.
