Description
Software parts llist NOTICE OF INTENT TO NEGOTIATE A SOLE-SOURCE CONTRACT The Defense Microelectronics Activity (DMEA) intends to negotiate on a sole source basis with Silvaco, Inc., 4701 Patrick Henry Dr Bldg. 2, Santa Clara, CA, 95054-1863to provide renewal of annual maintenance for Silvaco Technology Computer Assist Design, Universal Transistor Modeling Software and Semiconductor Program with Integrated Circuit Emphasis tools licenses for a base year and three option periods. Silvaco, Inc. is the manufacturer of the software tools and is the only contractor who can supply the software licensing. DMEA has continuing collaborative technical programs with other Government labs that utilize these Silvaco software tools, including National Aeronautics and Space Administration (NASA) and the Space and Naval Warfare Systems Center, Pacific (SPAWARSYSCEN Pacific). The statutory authority for other than full and open competition is 10 U.S.C. 2304 (c) (1), as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements and FAR 13.501(a)(1)(ii) Test Program for Certain Commercial Items under the authority of 41 U.S.C. 1901. This is not a Request for Proposal (RFP) or a Request for Quotation (RFQ); it is a Request for Information (RFI) as defined in Federal Acquisition Regulation (FAR) 15.201(e). Responses to this notice are not offers and will not be accepted by the Government to form a binding contract. This announcement is for information and planning purposes only and is not to be construed as a commitment by the Government, implied or otherwise, to issue a solicitation or award a contract. The Government will not pay for any cost incurred in responding to this announcement. Any information submitted by respondents to this Sources Sought synopsis shall be voluntary. The information submitted in response to the Sources Sought Notice will not be utilized to determine vendor standing in any future/potential Request for Quote/Request for Proposal, nor will it be utilized to determine if a vendor is qualified to submit a Request for Quote/Request for Proposal for any future/potential requirement. The notice and the information received shall not be used to determine how well respondents can perform a requirement, which can only be evaluated in response to a solicitation. Vendors will not receive formal notification or feedback on any information submitted in this Sources Sought request. All future/proposed submissions/solicitations requirements solicited on a Government Point of Entry will be evaluated independent of any information submitted in response to this Sources Sought Notice. No vendor will be provided information on solicitations issued on a Government Point of Entry based on this Sources Sought request. The Government will not entertain questions concerning this market research. The North American Industry Classification Code (NAICS) for this acquisition is 511210 with a business size standard of $38.5 million. This is not a solicitation for competitive quotes. However, if any other interested party believes that it can meet the requirements, it may submit a capabilities statement, which if timely received, will be considered by DMEA. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. The capability statement must be in writing and must contain material in sufficient detail to allow DMEA to determine if the party can meet all of the requirements. Capability statements, limited to four single-sided pages, shall be sent via e-mailed to fragoso@dmea.osd.mil by 07:00 A.M. PST, July 21, 2015.
