- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION I. CONTRACTING ACTIVITY Department of Air Force, 1st Special Operations Contracting Squadron, Hurlburt Field, FL. This document serves as a "Justification for Other Than Full and Open Competition" to exercise FAR Clause 52.217-8, Option to Extend Services for a 1 month contract extension. II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED This action is conducted under the authority of 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1 Circumstances Permitting Other Than Full and Open Competition. The proposed action will be awarded as a modification to existing contract number FA4417-13-D-0003 as a firm-fixed-price type contract. The current performance period expires on 31 August 2015. A one-month extension is necessary to align the period of performance of the remaining options with the Government Fiscal Year. III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS Under the contemplated one month extension, C C Distributors, Inc. will continue to provide all necessary labor, supervision, equipment, supplies and materials to support a COCESS located at Hurlburt Field, FL. The contractor shall acquire, issue, deliver, store and warehouse a variety of material, equipment, parts and supplies for the Self-Help/Tool Issue Center, construction, family housing repair, facility maintenance and maintenance on real property for use by civil engineer personnel and approved Self-Help customers. IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION Authority for this requirement is conducted through 10 USC 2304(c)(1), as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) The current period of performance is 1 September through 31 August, for the current option year and the three remaining option years. The period of performance as is, requires a lot of additional work on Civil Engineering (CE) and creates inefficiencies in the self-help store during the Government's fiscal year end. CE is required to create and close out each delivery order issued by the Contracting Office against the COCESS contract in the Civil Engineer Material Acquisition System (CEMAS) at the end of the fiscal year. With the current period of performance ending 31 August, CE is currently required to complete two close-outs at the end of the fiscal year. One for the period ending 31 August and one for the last month in the fiscal year, first month of the new option. This process creates a burden on CE and more importantly, limits the contract use during the peak month of the fiscal year, September. For the Government to perform the close-out process in CEMAS, every item requested/purchased must be finalized in CEMAS. The close-out process can take up to two weeks to accomplish. The Government is required to stop purchasing to ensure all purchases are finalized to complete the close-out in CEMAS. Normally the Government has to stop seven to ten days before the end of the fiscal year, which makes it impossible to complete the two close outs that would be required in one month (one for the period ending 31 August and one for the first month in the new option/last month of the fiscal year). CE attempted to perform a close out in CEMAS last year and create the new delivery order; however, they were not able to get to the point of loading the new funds for the new delivery order beginning 1 September. This prevented CE from purchasing needed items after the end of August until after 1 October. As is, the contract structure with the period of performance does not meet the customer's requirement. In order to align the period of performance of each option with the Governments fiscal year (1 October - 30 September), the Government intends to exercise FAR Clause 52.217-8, Option to Extend Services for a one month period to adjust option year 2 and remaining options to begin 1 October. It is inconceivable that another contractor could perform services required by this contract for the one-month period covered under this Justification for Other Than Full and Open Competition. This justification will be posted to Federal Business Opportunities. VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE This requirement was originally competed and four offers were received. FAR 52.217-8 was included in the solicitation and resulting contract. Due to the recent SAF/AQC guidance concerning the FAR 52.217-8 "option evaluation as part of the initial competition", this Justification for Other Than Full and Open Competition is being required. As the requirement was competed, a source sought is not required. After this one-month contract extension, the Government intends to begin the process to exercise Option Year 2, 1 October 2015 through 30 September 2016. VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE The anticipated cost during this period will be considered fair and reasonable. Pricing was previously determined fair and reasonable through adequate competition. The current Statement of Work specified in the contract will continue to be used in accordance with pre-established prices. The contract's previous period of performance, 1 September 2014 - 31 August 2015, pricing will be used for the one month extension; the previous period of performance pricing was determined fair and reasonable based on adequate price competition. VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED Market research pursuant to FAR Part 10 was not conducted for this Justification for Other Than Full and Open Competition as it is known the recently directed SAF/AQC FAR 52.217-8 option evaluation was not part of the initial competition. The failure to include the proper option evaluation as not part of the initial competition has been identified and training completed by all contracting personnel involved in this and future procurements. Extensive market research was performed in the pre-award process of the current COCESS contract, FA4417-13-D-0003. IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION No additional factors or supporting rationale. See paragraph V above for details. X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION See Section VI above. XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED No barriers to competition exist for this requirement in general. This requirement at Hurlburt Field has historically been made on a competitive basis and FAR Clause 52.217-8 is always included. Future solicitations shall include the required evaluation of options as part of the initial competition as recently directed by SAF/AQC via memorandum dated 20 August 2013. Additionally, future solicitations and resulting contracts will provide period of performances in line with the Government fiscal year due to CE's requirement associated with CEMAS. XII. CONTRACTING OFFICER'S CERTIFICATION The contracting officer's signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief (FAR 6.303-2(b)(12)). XIII. TECHNICAL/REQUIREMENTS PERSONNEL'S CERTIFICATION As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete (FAR 6.303-2(c)).
