- Attached is the J&A for the other than full and open award to Monaco. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION I. CONTRACTING ACTIVITY A. Contracting Agency: 341st Contracting Squadron B. Organizational Activity: 341st Civil Engineering Squadron C. Justification Type: Other Than Full and Open Competition D. Purchase Request Number: F2W3D95163AW01 II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSES This contracting action will be awarded as a new firm-fixed-priced contract. This acquisition is for a proprietary Brand Name transmitters, zone mother boards, and fire zone cards for the Monaco Fire Detection and Alarms System. III. DESCRIPTION OF THE SUPPLIES REQUIRED TO MEET THE AGENCY'S NEEDS The 341st Civil Engineering Squadron submitted a requirement for 130 each Brand Name only Monaco Transmitters, Zone Mother Boards, and Fire Zone Cards. 3400 O&M funds will be utilized for this requirement. The specifications of the requirement are stated below: EQUIPMENT SPECIFICATIONS: 130 ea. - Monaco Alarm Transmitters 130 ea. - Monaco Zone Mother Boards 130 ea. - Monaco Fire Zone Cards IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION This requirement will be procured from limited sources IAW 10 USC 2304(c)(1), as implemented by FAR 6.302-1 - Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) The 341st Civil Engineering Squadron currently uses the Monaco Fire Alarms System here at Malmstrom AFB. The system has not been upgraded in the last ten years and as so, there are maintenance and equipment requirements that must be maintained and replaced in order to prolong the success and capabilities of the alarm system. The equipment and parts are proprietary to this particular system and will not work with other systems. Acquiring a different alarm system as a whole would incur the additional cost of training as well as doubling maintenance and equipment costs due to maintaining two different systems. By procuring an identical system, maintaining will be standardized and costs would be easier to control. VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE A Request for Quotes posted to GSA Advantage under the number F2W3D95163AW01. The RFQ outlined the requirements for Monaco specific parts and opened the opportunity for quotes to the public. After posting the requirement to GSA, there were multiple vendors who submitted responses back stating that they could not meet the requirements due to the fact that they do not provide the proprietary products requested. VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE The quoted price is determined to be fair and reasonable based on the tradeoff costs to remove the in-place alarm system and replace it with a brand new commercial fire alarm system. In the event that this was to take place, the incurred cost to the Government would be estimated to exceed $2M. This compared to the quoted price from Monaco for the maintenance parts and equipment is exponentially higher. Therefore, the cost to obtain the proprietary products is determined to be fair and reasonable. VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED Market research began by reviewing the requirement and understanding the need for proprietary goods versus commercially universal parts. Next, a RFQ was posted to GSA Advantage to seek competition for Monaco proprietary parts for the alarms system. After the close of the solicitation, it was apparent that Monaco was the only source capable of satisfying the Governments requirement due to the proprietary nature and them being the only distributor. IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION See section V. No further facts available X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION Monaco Enterprises XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED Due to the equipment being proprietary to Monaco Enterprises, there is nothing to include future sources for this requirement unless additional companies begin to provide this particular piece of equipment. XII. CONTRACTING OFFICER'S CERTIFICATION The contracting officer's signature on the Coordination and Approval Document evidences that he has determined this document to be both accurate and complete to the best of his knowledge and belief (FAR 6.303-2(b)(12)). XIII. TECHNICAL/REQUIREMENTS PERSONNEL'S CERTIFICATION As evidenced by his signature on the Coordination and Approval Document, the requirements personnel hereby certifies that this justification and approval for other than full and open competition is made in good faith, that the supporting data and information contained herein are both accurate and complete to the best of my knowledge and belief, and that I would not be making this request if it were feasible to fully compete this requirement. I further certify that this request is not the result of lack of advanced planning or a desire to expend funds while those funds are still available (FAR 6.303-2(c)).
