Description
This requirement was erroneously posted as a J&A, however should have been posted as a special notice. This requirement is now being posted as a Special Notice to sole source this requirement to Randox Laboratories. Previously in the J&A fbo.gov post, it was stated that this requirement would be awarded under PSA-15-005977, however, that order number was used to place an emergency order for these same requirements listed in this notice. Randox Reagents Emergency Order, Solicitation PSA-15-Q-000026 was posted and awarded on 13 July 2015 under order PSA-15-005977. This requirement for sole source award to Randox is being REposted as a special notice under solicitation number PSA-15-Q-000029. PSA plans to award a single firm fixed price contract for supplies from the sole source, Randox. Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.3 and in accordance with the requirements of FAR 6.301 and 6.303, the justification for the use of the statutory authority cited below is justified by the following facts and rationale. (1)Contracting Activity: This Justification for Other than Full and Open Competition (JOFOC) is issued by: Pretrial Services Agency for the District of Columbia Office of Finance and Administration / Procurement 633 Indian Avenue, NW Washington, DC 20004-2908 (2)Nature and/or description of the action being approved: This requirement is for the acquisition of the Randox Investigator analytical reagents for the detection of drugs of abuse, including Synthetic Cannabinoids and Bath Salt Designer drugs in Urine and Oral Fluid. Synthetic Cannabinoids and Bath Salts pose a serious threat to judicial monitoring and community safety. They present a daunting analytical challenge because until recently, they have been difficult to screen for. These Synthetic Cannabinoids alone are 4 - 100 times more potent than marijuana and individuals turn to using these herbal mixtures to avoid detection by standard drug test. (3)Description of the supplies or services required to meet the agency's needs (including the estimated value): The supplies and services required to meet the Agency's needs are: ***THESE ARE ESTIMATED QUANTITIES ONLY:*** CLIN 0001 Drugs of Abuse Array V Urine (EV3977/DOA CST XX) 71 each CLIN 0002 Drugs of Abuse Array V Urine Controls (EV3978/DOA CST XX)17 each CLIN 0003 Drugs of Abuse Array I Oral Fluids (EV3619)1 each CLIN 0004 Drugs of Abuse Array I Oral Fluid Control EV3649) 1 each (4)Statutory authority permitting other than full and open competition: FAR 8.405-6(b)(1). Only one source is capable of responding due to the unique or specialized nature of the work. (5)Demonstration that the contractor's unique qualifications or the nature of the acquisition requires the use of the authority cited: PSA is limiting competition to the Randox brand because the reagents must be compatible with PSA's current laboratory equipment. The reagents are used in an analyzer manufactured by Randox Industry's and the reagents must be compatible with the equipment. (6)Efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies: This requirement is for 1 year of supplies. The agency shall post its intent to sole source a year's worth of this requirement on Federal Business Opportunities (FBO) for a minimum of 30 days. (7)Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable: The contracting officer shall use price and/or cost analysis to determine price reasonableness. (8)Description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted: Research shows that Randox Laboratories is the sole manufacturer and supplier of the Biochip Array Technology based Evidence Investigator analyzer. The associated reagents are exclusively manufactured by Randox and are only commercially available from Randox global. (9)Other facts supporting the use of other than full and open competition: None. (10)Sources that expressed, in writing, an interest in the acquisition: None. (11)Actions the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required: PSA shall post this requirement to FBO.gov. PSA will continue surveying the commercial market place for alternate sources of supply for the required products. If alternative sources are discovered, PSA will consider issuing future solicitations on a more competitive basis.
