- The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis, under the authority of FAR 13.106-1(b) (1), with Max Dolinsky and Associates of Gaithersburg Maryland to provide software maintenance and software enhancements to the Chemical Editor (CHED)software used at NIST. The contractor shall provide one year of maintenance services for the CHED database currently used by NIST. Additionally, the contractor shall provide enhancements to the CHED database in the form of a capability to select data from different sources for a compound or several compounds and comparison, and the capability to allow an evaluator to compare spectral data (plots and/or tables) from two different entries and display differences. The sole source justification is based on the following: NIST has used CHED to develop and maintain a library of mass spectral data and gas chromatography retention index. CHED is a widely-used tool for identifying compounds in a wide range of pursuits, including petrochemical studies, environmental and industrial analysis, forensic science, toxicology, medical chemistry, drug development, agriculture, and food science. Max Dolinsky and Associates developed the CHED software, maintains all intellectual property and data rights to the software, and is the only source capable of providing maintenance of and enhancements to the software. The resulting purchase order will be a Firm Fixed Price purchase order. The NAICS Code is 511210 with a size standard of $38.5 Million. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, responses received by 12:00 pm EST August 6th, 2015, will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
