- Sole Source Letter Notice of Contract Action for Sole Source Award to Engility Corporation Notice of Contract Aciton (NOCA) for JRE to 3G Upgrade & Tech Support The Air Force Test Center (AFTC), Contracting Directorate, Edwards AFB, CA intends to issue a sole-source contract to Engility Corporation for Engility-JRE to 3G software packages, P/N: 30579 to control and interface with JTIDS Class II and MIDS LVT Link 16 terminals to route data that is used to stimulate the system under test (SUT) via Link 16 Line-Of-Site and Beyond-Line-Of-Site radio frequency (RF) networks. The anticipated contract will be a Firm-Fixed Price (FFP) sole source acquisition to Engility Corporation. Engility Corporation is the manufacturer of this item and is the sole owner of the proprietary data rights. Furthermore, there are no authorized pass-through opportunities available via Netcents-2. The statutory authority which permits other than full and open competition for this acquisition is 10 United States Code (USC) 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2)(iii)(A). This authority is supported by an approved and sole source letter (see attached). The applicable NAICS code is 511210 and the size standard, as defined by the U.S. Small Business Administration, is $38.5M. This notice neither constitutes a Request for Proposal (RFP) or an Invitation for Bid (IFB), nor does it restrict the Government in any way to an ultimate acquisition approach; however, all responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the Government. THIS IS NOT A REQUEST FOR PROPOSAL AND IS NOT TO BE CONSTRUED AS A COMMITMENT BY THE GOVERNMENT. AFTC has appointed an Ombudsman to hear concerns from potential offerors relating to this acquisition. The Ombudsman does not diminish the authority of the Program Director or Contracting Officer, but communicates contractor concerns, issues, disagreements, and recommendations to the appropriate Government personnel. When requested, the Ombudsman will maintain strict confidentiality as to the source of the concern. The Ombudsman does not participate in the evaluation of proposals or in the source selection process. Matters of a routine or administrative nature concerning this acquisition should not be addressed to the Ombudsman but rather the Contracting Officer identified below.
