Description
The U.S. Fish & Wildlife, Office of Law Enforcement, (USFWS/OLE) intends to negotiate on a sole source basis with Sig Sauer Inc. under the authority of 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. The USFWS/OLE has a requirement for to purchase 202 special agents with a Sig Sauer P290 pistol as a non-primary firearm. The Sig Sauer pistol in the model P290 are authorized by the Chief, Office of Law Enforcement under Chiefs Directive CD-B1(Rev. 1), dated January 22, 2015, for use by Service Special Agents for alternate firearms for specific operation or investigations. The Lead Regional Firearms Committee (LRFI), recommended the P290 after rigorous testing and evaluation of several secondary side arms. The LRFI also took into consideration the armoring of a secondary sidearm by Service Designated Armorers (SDA). All SDAs are proficient in the Sig Sauers Classic line of pistols so the LRFI recommended the P290 from a safety aspect of maintaining the weapons for the agents. Sig Sauer is the sole source manufacturer of these pistols. The Sig Sauer P290 comes directly from the manufacturer at a cost of $359 per weapon. The total for this order will be $72,518. Per Part 442 FW 1(A), ¿Service law enforcement officers may only use Service-owned and issued firearms and ammunition for law enforcement purposes, and CD-B1 (Rev. 1), Approved Secondary Sidearms are: SAs: SIG SAUER INC model P290 in 9mm Sig Sauer Inc., is the sole source manufacturer of these pistols. The Sig Sauer pistol models ordered are specifically designed for law enforcement purposes and are sold to law enforcement agencies or military. The Sig Sauer pistols come with a magazine disconnect that allows the weapon to be fired without a magazine in the weapon. Each firearm is received directly from the manufacturer where it has under gone quality control and safety standards testing prior to being received by the officer therefore eliminating a possibility of modification or reliability. Additionally, ordering directly from Sig Sauer Inc., the large quantities needed to supply enough weapons for the agents can only be provided from the manufacture to ensure sequential serial numbers and minimize the number of lots in case of a recall and a quality control perspective. The NAICS code is 332994 Small Arms, Ordinance, and Ordnance Accessories Manufacturing. A determination by the Government not to compete the proposed effort on a full and open competition basis is solely within the discretion of the Government. This is not a competitive solicitation and quotes are not being requested, however, any responsible contractor capable of meeting the requirement may submit technical and past performance data sufficient to determine capability. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement for future acquisitions. A firm-fixed price commercial purchase order will be awarded NLT July 31, 2015.
