- Intent to Award Sole Source It is the intent of the National Archives and Records Administration (NARA) to enter into a firm fixed price purchase order with Audio Intervisual Design for support and maintenance of Sondor film scanners at the National Archives at College Park. The proposed action will be conducted in accordance with FAR Part 12, Acquisition of Commercial Items. The NAICS code is 811211. The proposed action is for support and maintenance for which the Government intends to solicit and negotiate under the authority of FAR 6.302, only one responsible source and no other supplies or services will satisfy agency requirements. Interested persons may identify their interest and capability to respond to the requirement or submit quotations no later than 12:00 p.m. eastern time August 10, 2015. This notice of intent is not a request for competitive quotations. However, all quotations received after the date of publication of this synopsis and prior to 12:00 p.m. eastern time August 10, 2015, will be considered by the Government. A determination by the Government not to compete this proposed purchase order based upon responses to this notice is solely within the discretion of the Government. This purchase order will be awarded using simplified acquisition procedures in accordance with FAR Part 13. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs incurred in responding to this notice. IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY, AND SPECIFIC IDENTIFICATION OF THE DOCUMENT AS A "JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION" See Page 1 II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED NARA seeks to make a sole source purchase for support and maintenance of our suite of Sondor film scanners. Sondor is the only manufacturer of the scanners and accompanying software and Audio Intervisual Design (AID) is the only licensed US distributor of their products. The original equipment was purchased over the course of the past five years for a total of $482,294 from Audio Intervisual Design. This requisition will place all four pieces of equipment under one service agreement whereas they had been under several separate service agreements. Sondor is the only manufacturer of these scanners and AID is the only licensed US distributor of their products. Therefore AID is the only company able to offer a support contact for these scanners which NARA requires to provide greater access to the film collection. III. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS (INCLUDING THE ESTIMATED VALUE) The estimated cost for the service and support of all NARA's Sondor equipment is: Service and Support for base year and two options years: $ IV. AN IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION. 41 U.S.C. 3304(a)(1) -"Only One Responsible Source" as implemented by FAR 6.302-1. V. A DEMONSTRATION THAT THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED This acquisition meets the authority of FAR 6.302-1 which states that this authority may be used "when the supplies or services required by the agency are available from only one responsible source, or,...from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for." See above II. VI. A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED AS REQUIRED BY SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION UNDER 5.202 APPLIES. Sondor is the sole manufacturer and AID is the sole distributor of Sondor products in the United States. No other companies can provide the support or service for these scanners. Market research was conducted via web-search. Only Sondor and AID returned results showing the ability to support this equipment. An Intent to Sole Source will be posted on Federal Business Opportunities for 15 days. VII. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE The cost of the support and maintenance agreement is approximately 4% of the total cost of all the equipment. This is in line, if not far less than, the industry standard as a whole for support of moving image scanning equipment. Based on the information provided, the anticipated cost will be fair and reasonable. VIII. A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED (SEE PART 10) AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED See paragraph VI. above. IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION. SEE FAR 6.303-2(a)(9) None. X. A LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE ACQUISITION N/A XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED NARA will remain abreast of changes in the availability of upgrades and support for this equipment; for example, availability via authorized re-sellers and distributors, as well as offerings via GSA schedule.
