- Description
- This contract action was accomplished using other than competitive procedures because the procurement is awarded to a sole source under the Test Program for Certain Commercial Items (FAR 13.5). See posted J&A for further information. 1. CONTRACTING AGENCY: Kansas City District, U.S. Army Corps of Engineers, Contracting Division, 601 E. 12th St., Kansas City, MO 64106. 2. DESCRIPTION OF ACTION: This action is for a new, firm fixed price single source requirement using Fiscal Year 2015 Operations and Maintenance (Civil) funds for one gate seal at the Tuttle Creek Lake control tower. 3. DESCRIPTION OF SERVICE: The U.S. Army Corps of Engineers, Kansas City District, requires one (1) new gate seal for the Tuttle Creek project to ensure the continued operation of the flood control project as designed. The requirement cost is estimated to be approximately $8,000. The source for this purchase is Seals Unlimited, 23050 NW Jacobson Road, Hillsboro, OR 97124. The period of performance will be six (6) weeks from award. There is not an option for an additional gate seal, and there is no continuation of services clauses. This contract will result in a vendor delivering the seal to the Tuttle Creek project. Installation of the gate seal is not required of the seal fabricator. 4. AUTHORITY CITED: FAR 13.106-1(b), Soliciting from a single source. 5. REASON FOR AUTHORITY CITED: a. BACKGROUND: The U.S. Army Corps of Engineers Tuttle Creek Project has experienced failure of one (1) of the gate seal. A new seal is needed to prevent leakage of water. The Tuttle Creek gates were designed with a seal custom made by Seal Unlimited. No other manufacturer has a mold to create seals which will fit the Tuttle Creek gates. b. JUSTIFICATION: All facts and assumptions are based on discussion with the Project Manager, Kenneth Stark. Facts: Seals Unlimited manufactured the original seals for the Tuttle Creek gates. Seals Unlimited has maintained the mold used to make seals for the Tuttle Creek gates. The Tuttle Creek gates have a custom seal, and no other seals on the market place which are compatible with the gates. The service gate #1 is under contract for repair and will be removed for maintenance. The most cost effective time to replace the failed seal is now while the gate is removed since a large portion of the gate repair cost is the removal and installation of the gate. Once the gate is back in the tower and in-service, the seal can not be replaced. The gate would have to be reremoved and re-installed, so the taxpayer would be paying for expensive crane mobilization and gate removal/installation twice. Therefore, the gate seal should be ordered from Seals Unlimited now. Assumptions: Reverse engineering a new mold would be expensive and time consuming. It was not feasible to seek competition for this requirement due to the custom nature of the Tuttle Creek gates and the immediate need for replacement of the failed seal.
