- LIMITED SOURCE JUSTIFICATION & APPROVAL FAR PART 8 ACQUISITIONS Multiple Award Schedule (MAS)/Multiple Award Contract (MAC) Orders under MAS/General Service Schedules (GSA)/Federal Supply Schedules (FSS) FAR 8.405-6 Purchase Request Number: DDDMC40010 Contract Number: HC1047-14-F-0032 Task/Delivery Order Number: GS-10F-143AA Procurement Title: Sign Language Interpreter Services Contracting Office: PSD 63 Estimated Value: $XXXXX Limited Source Authority: FAR 8.405-6(a)(1)(i)(A) LIMITED SOURCE JUSTIFICATION J&A Number: n/a____ Upon the basis of the following justification, I, as Contracting Officer, hereby approve this limited source justification in accordance with FAR 8.405-6(a)(1)(i)(A). The acquisition referenced herein is conducted under the authority of the Multiple Award Schedule Program. JUSTIFICATION 1. REQUIRING AGENCY a. DISA Directorate/EEO Tynette A. Pierre, Program Manager b. CONTRACTING OFFICE: DITCO-NCR/PL63 2. NATURE/DESCRIPTION OF ACTION(S): The nature of this action is to issue a Labor Hour modification to increase the services on this task order #HC1047-14-F-0032 with Mid-Atlantic Interpreters due to additional requests for EEO Interpreter Services for the Option Year 1 in the amount of $XXXXX (15 January 2014 to 14 January 2015. The current option year $XXXX. Option Period 1 - FY15 O&M funds have been provided in the amount of $XXXX. This modification is required to avoid a break in essential services. The current ceiling is $XXXXX and will increase by $XXXX to $XXXX over the lifecycle. FY15 O&M funding will be used. 3. DESCRIPTION OF SUPPLIES/SERVICES: DISA Directorate/EEO's mission is to provide interpreter services for the DISA deaf and hard of hearing community. Activities may include (classified or unclassified) meetings, Agency meetings, supervisory meetings, training classes, and other settings where a hearing impaired employee may require the services of an interpreter. Interpreters must be able to interpret/transliterate fluently and understand the continuum of sign communication. Interpreters must provide, as a minimum, interpreting services in American Sign Language. The estimated cost of support for the increase in services are as follows: Option Year 1 (1/15/14 -1/14/16) - from $XXXXX by $xxxxx to $XXXXX. New total contract value - from $XXXX by $XXXXX to $XXXXX. Sign Language Interpreter Services Page 2 of 4 Pages 4. IDENTIFICATION OF LIMITED SOURCE AUTHORITY AND DEMONSTRATION OF CONTRACTOR'S UNIQUE QUALIFICATIONS: EEOD is the focal point for ensuring interpreter services are available for those with hearing disabilities for Defense Information Systems Agency (DISA) in accordance with Federal equal opportunity statutes. These services cover a range of sign language interpreter service activities within but not limited to the National Capital Region (NCR). (a) Circumstances Justifying Limiting the Source. FAR 8.405-6 (a)(1)(i)(A), an urgent and compelling need exists, and following the ordering procedures would result in unacceptable delays. (b) Description of the Justification. Under the 1973 Rehabilitation Act, DISA must provide reasonable accommodation to qualified employees or applicants with disabilities, unless to do so would cause undue hardship. DISA is committed to providing reasonable accommodations to its employees and applicants for employment to ensure that individuals with disabilities are provided equal access to all employment opportunities. To continue to provide these services, DISA's EEOD office must increase the hours of the current labor hour contract, HC1047-14-F-0032. The estimated hours for services anticipated prior to award have been used with 6 months still remaining in the period of performance. Mid-Atlantic Interpreting Group, Inc (MAIG) is currently providing services under this contract and can continue to do so without a disruption in services. (1) The current estimated hours of the contract were predicted by conducting a census of how many hours would need to be provided per deaf employee from June 2015-January 2016. There has also been an increase of the number of deaf employees. These increases in requests for service over the past two months in all hours for cleared and uncleared services could not have been predicted at time of contract award. (2) The Contracting Officer Representative provided the Contracting Officer with the need to increase the labor hours due to increase in support services to the DISA community. (3) This need is urgent and compelling due to a current need for service. To recompete this contract due to the additional hours needed will cause DISA to fail to comply with Federal mandates. (c) Justification: (1) Minimum Government requirements. At minimum, additional hours of Interpreter Services are needed for the remainder of the contract. (2) Proposed sole source contractor. Mid-Atlantic Interpreting Group, Inc. is currently providing services and can accommodate an increase in hours without a disruption to the contract. (3) Discussion regarding cause of the limited source situation. Due to an unexpected increase in personnel requests for sign language services within the past two months and for the remainder of the contract, DISA has received requests totaling more than the original hours anticipated for the contract. (4) Demonstration of limited source. Awarding this contract to another contractor could not be done in a timely manner without disrupting services and leaving DISA's deaf community without reasonable accommodations. Disruption of these services could lead to legal consequences costing the Government. Sign Language Interpreter Services Page 3 of 4 Pages (5) Procurement discussion. These commercial services were procured using full and open competition. There are no unique features of these services. The only cause for not competing these additional hours is a lack of time due to not being able to anticipate a surge in current needs. (6) Impact. DISA may be held liable of not providing a reasonable accommodation to its employees and applicants to perform the essential functions of their positions. 5. BEST VALUE DETERMINATION: (FAR 8.405-6(c)(2)(v)) (a) A review of all pricing options was examined and it is determined that the order represents the best value IAW FAR 8.404(d). (b) GSA has already determined that prices of supplies, fixed price services, and rates for services offered at hourly rates are fair and reasonable; therefore, no additional fair and reasonable determination is required when using Part 8.It is also determined that the labor categories for this requirement are fair and reasonable and a price evaluation was completed at time of award IAW FAR 8.404(d)). (c) For orders exceeding the simplified acquisition threshold, the contracting officer must seek a price reduction IAW FAR 8.405-4. Indicate that this was accomplished at time of award. 6. MARKET RESEARCH: Market Research was conducted at time of award (within the last 12 months) and it was found that this requirement could be satisfied by numerous small businesses under GSA Schedule 70. Though other contractors are available to fulfill these services, there are no alternatives to limiting sources at this time due to the urgent and compelling nature of the requirement. 7. ANY OTHER SUPPORTING FACTS: N/A 8. ACTIONS THE AGENCY MAY TAKE TO REMOVE BARRIERS THAT LED TO THE RESTRICTED CONSIDERATION: (FAR 8.405-6(c)(2)(viii)) (a) Procurement history. The following items of information are expected. (1) The current contract, HC1047-14-0032, was awarded 15 January 2014. The current period of performance is 15 January 2015 - 14 January 2016. The previous contract, HC1047-08-F-0357 had a five year period of performance. (2) These contracts were solicited for using full and open competition. (3) There are no brand-name, exception to fair opportunity, limited-sources, and/or exception to full and open competition authorities cited for related prior actions. (b) There are no barriers to full and open competition. (c) The current circumstances are due to the inability to predict a surge in agency needs. Future needs will be awarded without the need for a brand-name, exception to fair opportunity, limited-sources, and/or exception to full and open competition justification. 9.
