- The Army Contracting Command - Redstone Arsenal (CCAM-RDI), Fort Eustis, VA, intends to negotiate with only one source under the authority of FAR 6.302-1(a)(2)(ii), quote mark Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements quote mark, with Robertson Fuel Systems, L.L.C., to modify the existing UH-60 Aircraft Crashworthy External Fuel System (CEFS) Pump Package. The fuel system, manufactured by Robertson Fuel Systems, LLC, is designed to transfer fuel from external tanks to No. 1 and No. 2 main tanks. The proposed contract action is for SUPPLIES/SERVICES only available from the company named in this notice. REASON AUTHORITY CITED Robertson Fuel Systems L.L.C., Tempe, AZ owns the proprietary rights to the drawings and manufacturing process for these fuel systems, associated parts and repair rights for the fuel system. Robertson Fuel Systems is the only authorized vendor able to perform all three levels of maintenance and repair and is the only vendor authorized to overhaul and retrofit the internal components of these fuel systems. The Robertson fuel system is the only fuel system approved with an Air Worthiness Release (AWR) for the fleet of 160th Special Operation Aviation Regiment (Airborne) (160th SOAR (A)) aircraft. Furthermore, their predecessor company, Robertson Aviation LLC, developed the fuel systems and repair processes at private expense and has no interest in selling these rights to the Government at this time. The Government does not own sufficient rights to the data to allow open competition. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all capabilities statements or proposals received prior to the closing date set in this synopsis will be considered by the Government. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
