Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by FAR Subpart 6.3 and in accordance with the requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR Subpart 6.3 is justified by the following facts and rationale required under FAR 6.303-1 as follows: (1)Agency and Contracting Activity-The United States Coast Guard, proposes to include in the specifications for the Major M&R Project Lower Government Hill Housing at Base Kodiak, AK requirements for particular brand name products. (2)Nature and/or description of the action being approved. - Approval for sole source brand name specific materials. (3)Description of Supplies/Services - ¬ The following supplies are anticipated. The following items have been identified in this specification: SECTION 07 30 00 STEEP SLOPE ROOFING Roof Covering and underlayment: CertainTeed Landmark TL, 50 year. Ridge shingles; CertainTeed Presidential Shingles, Underlayment: CertainTeed "Winter-Guard", Eave protection: Grace Ice & Water Shield. Matches existing materials used and inventoried, for base wide application. Cost: $15,000 Total Project Estimated Cost for sole source items is $15,000 and is less than $650,000. (4)Identification of Statutory Authority Permitting Other Than Full and Open Competition The statutory authority permitting other than full and open competition is USC 2304(c)(1) implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled "Only one responsible source and no other supplies or services will satisfy agency requirements." Only the specific brand names included in the specifications will satisfy the Coast Guard's requirements so that the base can be maintained by the BOSS contract. Therefore FAR 6.302-1(a)(2) is applicable. (5)Demonstration That the Nature of the Acquisition Require Use of the Authority Cited. Base Kodiak is the USCG's largest base. Additionally, it is located on a remote island in Alaska. Standardization of construction products optimizes maintenance practices and inventory requirements. Specific manufacturer's products are required as they are part of a "system." In order for the entire system to work, the products must be exactly the same, so they properly integrate with established systems. In order to effectively and efficiently maintain the Base, they must be built with these specific materials so that in an emergency response situation, the BOSS contractor is able to make the needed repairs with available parts on hand without first determining what the make and model of the item is, then procuring that item. Should the item not be available on island, additional time will be lost in responding to the emergency situation while the product is specially shipped to Kodiak Island. Therefore, it is imperative that the facilities being maintained under this contract be made with the parts available to the BOSS Contractor so that the "system" is properly maintained. (6)Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The commercial marketplace on island only provides a limited number of manufacturer's products. The products required to maintain the BOSS Contractor's maintenance system are provided through the local on island market place. Getting any other products can be time consuming due to the remote location of Kodiak Island, AK. Additionally, other manufacturer's parts will need to be customized or adapted to work with the existing brands already in use. Therefore, it is not practical and will result in increased cost to the Government if other brands are allowed for use for these specific items as described above. (7)Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable. The contracting officer determined that the anticipated price(s) will be fair and reasonable as they will be included as part of a firm fixed price in competitive proposals. The materials will be purchased at local commercial market place prices and these prices will be included in the lump sum competitive prices offered by the Contractors responding to the RFP. (8)Description of Market Research. The Base Kodiak Standard Construction Specifications have been vetted and market research has been done to support and establish the specifications. These standards have been established with support of the base personnel and the most effective and readily available product has been selected for incorporation into these standard specifications. Many suppliers provide these products in the commercial marketplace nationwide, however, these specific brands of products are the most readily available on island. (9)Any Other Facts Supporting the Use of Other Than Full and Open Competition. N/A. (10)A Listing of the Sources, if Any, That Expressed, in Writing, an Interest in the Acquisition. None. (11)A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services Required. As the particular brand selected for the Kodiak Standards age and are no longer produced by their manufacturers, new products will be selected and the most competitive product will be selected for use under the BOSS Contractor maintenance system.
