- THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute on Drug Abuse (NIDA), Station Support Contracts and Simplified Acquisitions Branch (SS/SA) on behalf of the National Institute of Aging, Intramural Research Program intends to negotiate and award a Purchase Order without providing for full and open competition (Including brand-name) to Propel Labs, 345 East Mountain Ave, Fort Collins, CO 80524 for the Tri Laser S3, 405 100m W upgrade and custom filter set. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 334516-Analytical Laboratory Instrument Manufacturing with a Size Standard of 500. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2005-83, dated July 7, 2015. This acquisition is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold ($150,000). STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. DESCRIPTION OF REQUIREMENT Tri Laser S3, 405mm Laser upgrade Background - The National Institutes of Health (NIH) is the nation's leading medical research agency and the primary Federal agency whose mission is to seek fundamentals knowledge about the nature and behavior of living systems and the application of that knowledge to enhance health, lengthen life and reduce illness and disability, conducting, supporting and making medical discoveries that improve people's health and save lives. NIA, one of 27 institutes, leads the federal government in conducting and supporting research and aging and the health and well-being of older people. The Institute seeks to understand the nature of aging and the aging process and disease and condition associated with growing older in order to extend the healthy, active years of life. Purpose and Objectives The purpose of this requirement is the purchase and installation of 405 mm laser and custom filter blocks for the S3 sorter. Period of Performance 60 days after receipt of contract award Contractor Requirements The contractor shall deliver, install and provide onsite training for the Propel (Bio-Rad) Tri Lase S3, 405mm Laser upgrade, (PL00183-custome, upgrade optics and hardware, 3 laser software to control 405mm laser excitation line and 405mm laser) and PL00184-custome (custom filter set) The Government owns the scientific instrumentation. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10-Market Research, specifically the review and evaluation of the responses to the sources sought notice published in the FedBizOpps on June 18, 2015, HHS-NIH-NIDA-SSSA-SBSS-2015-461 405 mm laser upgrade. The Government owns the Propel (Bio-Rad) Tri Lase S3, 405mm Laser so the parts are specific for the Bio-Rad S3 sorter and are not available by other manufactures or other vendors and must be installed by a Propel (Bio-Rad) field service representative in order to maintain the integrity of the instruments service contract. CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must include unit price, extended price, percentage discounts, shipping, freight, installation, and training cost as applicable.
