- Brand Name Justification (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) The solicitation number N68335-15-T-0367 is being issued as a Request for Quotation (RFQ). This requirement is a limited competition Brand-name only procurement between the Original Equipment Manufacturer (OEM) National Instruments and its authorized distributors, no set-aside preference, under FAR 13.5 procedures. (iii) The solicitation and incorporated provisions and clauses are in effect through Federal Acquisition Circular 05-83. (iv) This RFQ is being issued on a limited competition Brand-name basis as stated in paragraph (ii). The RFQ is open to Large and Small Business sizes. The North American Industrial Classification System (NAICS) code for this procurement is 511210, and the small business size standard is $38.5M. (v) The Contract Line Item Number (CLIN) is firm-fixed-price (FFP) and is listed as follows: CLIN 0001 Nomenclature: CD/DVD of LabVIEW 2015 Professional Development System, Windows OEM: National Instruments P/N: 776678-35 LabVIEW 2015 Professional Dev System, Windows, English. NI Software Service provides free, automatic upgrades for your software & access to NI Application Eng via phone/email for tech support. Quantity: 6 Each (vi) New items only; no remanufactured or "gray market" items. (vii) Inspection and Acceptance is at Destination. All items shall be preserved, packaged, packed and marked in accordance with best commercial packages. The items referenced in paragraph (v) are to be shipped FOB Destination to Lakehurst, NJ; full address to be provided at time of award. Delivery shall be twenty (20) days after receipt of order. Accelerated deliveries will be acceptable at no additional cost to the Government. (viii) Offerors must comply with the following commercial item terms and conditions, which are incorporated herein by reference: FAR 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition. (ix) FAR 52.212-2, Evaluation - Commercial Items is incorporated by reference. Addendum to FAR 52.212-2 Para (a): Award will be made to the responsible offeror whose quotation is lowest in price and in full compliance with all requirements set forth in this solicitation. For evaluation purposes, the lowest price will be determined by the total price of CLIN 0001 in paragraph (v). EXAMPLE EVALUATION: CLIN QUANTITY UNIT PRICE EVALUATED PRICE 0001 20 EA $12.00 $240.00 $240.00 (TOTAL EVALUATED PRICE) (x) Offerors shall include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items Alternate I with its offer. In its quotation, the offeror shall notify the Contracting Officer which FAR and DFARS provisions have been completed electronically as part of its annual representations and certifications and shall complete and return the remaining FAR and/or DFARS provisions.
