- This is a COMBINED SYNOPSIS/SOLICITATION for commercial supply prepared in accordance with the information in FAR Subpart 12.6, using Simplified Acquisition Procedures under the test program for commercial items found at FAR 13.5, as supplemented with the additional information included in this notice. This announcement constitutes the only solicitation; a written solicitation will not be issued. PAPER COPIES OF THIS SOLICITATION WILL NOT BE AVAILABLE. This combined synopsis/solicitation SHALL be posted on both FEDBIZOPPS and NECO (http://www.neco.navy.mil/). The RFQ number is N00244-15-T-0215. This solicitation documents and incorporates provisions and clauses in effect through FAC 2005-83 and DFARS Change Notice 20150626. It is the responsibility of the contractor to be familiar with the applicable clauses and provisions. The clauses may be accessed in full text at this address: http://farsite.hill.af.mil/. The NAICS code is 334290 “ Other Communications Equipment Manufacturing and the small business standard is 750 employees. The proposed contract action is for a brand name only. The Naval Supply Systems Command (NAVSUP) Fleet Logistics Center San Diego (FLCSD) requests responses from qualified sources capable of providing Brocade Communications Systems, Inc. (Brocade) products listed in Attachment 1 Parts List. The proposed contract action is for brand name only. In accordance with FAR 5.102(a)(6), the required justification or documentation is attached (see Attachment 2). Delivery is not later than 30 September 2015; Delivery Location is Monterey, California. Responsibility and Inspection at Government location and by the Government, respectively, unless otherwise specified in the order; the supplier is responsible for the performance of all inspection requirements and quality control. PAYMENT: WIDE AREA WORKFLOW (WAWF) SPECIAL REQUIREMENTS: - For Warranty purposes, offeror shall be authorized and certified reseller of Brocade products; submit Brocade authorization/certification with quote. - Quote shall be for NEW products; NO refurbished, NO remanufactured or gray market items. All items must be covered by the Brocades warranty. - Quote shall be for śAll or None. ť Award will be made to the vendor that quoted all and shall deliver all required items. Required individual items quantities are firm; No plus (+) or minus (-) within the quantity when quoted and on delivery. No partial shipments are permitted unless specifically authorized at the time of award. (a) Evaluation and Award Determination. Award will be made to the vendor whose quote represents the best value to the Government. Best value determination will be based on the lowest priced technically acceptable quote. Acceptability will be determined by an evaluation of the quoted requirements that meet the criteria that is contained in the solicited items and descriptions. The Navy will consider all quotes starting from the lowest priced submission. The Government reserves the right to evaluate the next lowest priced submission until it has determined an acceptable quote. The evaluation will stop at such point when the Government has determined that a quote is technically acceptable with the lowest evaluated price. Contingent upon a determination of contractor responsibility, award will be made to that offeror without further evaluation of other offers. Award will be made to the responsible vendor whose quote is accepted as the lowest priced technically acceptable. 252.203-7998 Prohibition on Contracting with Entities that Require Certain Internal Confidentiality Agreements ”Representation (DEVIATION 2015-O0010) (FEB 2015) (a) In accordance with section 743 of Division E, Title VIII, of the Consolidated and Further Continuing Resolution Appropriations Act, 2015 (Pub. L. 113-235), Government agencies are not permitted to use funds appropriated (or otherwise made available) under that or any other Act for contracts with an entity that requires employees or subcontractors of such entity seeking to report fraud, waste, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or contactors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information. (b) The prohibition in paragraph (a) of this provision does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information. (c) Representation. By submission of its offer, the Offeror represents that it does not require employees or subcontractors of such entity seeking to report fraud, waste, or abuse to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or contactors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information. (b) The Contractor shall notify employees that the prohibitions and restrictions of any internal confidentiality agreements covered by this clause are no longer in effect. (c) The prohibition in paragraph (a) of this clause does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information. (d)(1) In accordance with section 743 of Division E, Title VIII, of the Consolidated and Further Continuing Resolution Appropriations Act, 2015, (Pub. L. 113-235), use of funds appropriated (or otherwise made available) under that or any other Act may be prohibited, if the Government determines that the Contractor is not in compliance with the provisions of this clause. (2) The Government may seek any available remedies in the event the Contractor fails to perform in accordance with the terms and conditions of the contract as a result of Government action under this clause.
