- THIS IS NOT A REQUEST FOR QUOTE - THIS IS A NOTICE OF THE GOVERNMENT'S INTENT TO ISSUE A SOLE SOURCE AWARD CONTRACT TO FREMANTLE MEDIA FOR TELEVISION PROGRAMMING This is a Notice of Intent to issue a firm-fixed-price purchase order to Fremantle Media, Ltd, 1 Stephen St, London, England W1T 1AL on a sole source basis under the authority of FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, 10U.S.C. 2304(c)(1). Sole Source Justification is attached hereto. The proposed procurement is for TV programming as outlined below for American Forces Network - Broadcast Center (AFN-BC), located at the Defense Media Activity, 23755 Z Street, Riverside, CA 92518. a. DESCRIPTION: CLIN 0001: TV Programming - DESCRIPTION - The Contractor shall grant the Government (AFN-BC) the right to use and reproduce television programming and to distribute the programming by encrypted, digitally compressed satellite transmission system (currently Cisco's PowerVu Plus (MPEG-4)) and/or by mail to authorized AFN-BC television outlets outside the contiguous United States for their non-commercial distribution/-presentation via television broadcast frequencies, encrypted, digitally compressed satellite transmission, and/or limited closed-circuit distribution systems. BROADCAST RIGHTS: The Contractor shall grant the Government AFN-BC the right to reproduce, distribute and present the programming on authorized AFN-BC television outlets outside the contiguous United States for Line Items 1 - 2 for two(2) runs over a one (1) year period from date of initial Government distribution, for the following programs: ITEM RUNTIME TITLE EPISODES DELIVERY 1 30 Family Fued ('15 - '16) 200 9/21/2015 2 60 American Idol (Yr 15, Eps 11-45) 35 9/30/2015 This notice of intent is NOT a request for proposals or quotations. Requests for copies of a solicitation in response to this notice will not be honored or acknowledged. A determination by the Government not to compete this proposed action based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether conducting a competitive procurement is in the best interest of the Government. All information submitted should support the offeror's capability to provide the item required, and shall be furnished at no cost or obligation to the Government. Responses must be in writing and must provide clear and concise documentation indicating an offeror's bona fide capability to provide this service. Verbal responses are not acceptable and will not be considered. The Government reserves the right to cancel the Sole Source Award. The primary North American Industry Classification System (NAICS) code is 512120 - Motion Picture and Film Distribution, and the small business size standard is $32.0M. This notice of intent is not a request for competitive quotations; however, all responses received within seven (7) days of the issuance of this notice will be considered by the government. A determination by the government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
