INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA) on behalf of the National Institute of Arthritis and Musculoskeletal and Skin Diseases (NIAMS), intends to negotiate and award a purchase order without providing for full and open competition (Including brand-name) to Becton Dickinson and Company, 2350 Qume Drive, San Jose, CA 95131 for Flow Cytometry System maintenance service of FACSAria Fusion Cell Sorter. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code is 811219 - Other Electronic and Precision Equipment Repair and Maintenance with a Size Standard of $19.0 Million. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2005-83, Effective 02, July 2015. This acquisition is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold ($150,000). STATUTORY AUTHORITY This acquisition is conducted under the authority of 41 U.S.C. 253(c) under provisions of the statutory authority of FAR Subpart 6.302- (1) FAR 6.302-1-Only one responsible source and no other supplies or services will satisfy agency requirements. DESCRIPTION OF REQUIREMENT Coverage must include the BD FACSAria Fusion System with 4 Lasers and one Computer Workstation (excluding printers) for labor, travel expenses and parts (excluding consumables), for the following: - -Two (2) Preventive Maintenance Inspections to be performed during a twelve-month period, including 2 PM Kits. - Software Revisions released during the Agreement term. - Unlimited service visits, Monday-Friday, exluding holidays - Unlimited telephone support for instruments, reagents and applications will be provided at no additional charge. BACKGROUND The FACSAria Fusion high-speed cell sorter was purchased in 2014. The fusion is a five-laser system (355, 405, 488, 561, 640 nm) equipped with 19 optical detectors. This system, however, is contained within a laminar flow biosafety cabinet, which protects the operator from biohazards and maintains a sterile air environment for the sample. PURPOSE AND OBJECTIVES Service and maintain the FACSAria Fusion Cell Sorter through establishment of a vendor service contract. Proper maintenance and service is required to assure reliable, uninterrupted operation of the FACSAria Fusion high-sped cell sorter, this instrument is critically important to achieve the NIAMS mission. PERIOD OF PERFORMANCE This is a fixed-price contract. The period of performance will include a base award of 1 year (from award date) and 4 option periods of 1 year each. PROJECT DESCRIPTION This is a requirement for Service and maintenance of the BD Biosciences (BDB) FACSAria Fusion Cell Sorter (SN: P656700000039) operated by the NIAMS Flow Cytometry Service (FCS) of the Office of Science and Technology. OTHER IMPORTANT CONSIDERATIONS The proposed contractor does not certify third party organizations to perform service on its equipment and as the original manufacturer, can supply spare or replacement parts in addition to instrument software revisions, which is provided with the maintenance contract. The proposed contractor is the sole manufacturer of this equipment and the sole provider of the maintenance service for theFACSAria Fusion Cell Sorter. CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by September 3, 2015 at 5 pm Eastern Standard Time (EST) and must reference number HHS-NIH-NHLBI-CSB-AR-2015-218-SC.
