- DFAR 252.209-7999 This is a combined synopsis/solicitation for commercial items prepared in accordance with FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation and a written solicitation will not be issued. Provisions and clauses in effect through FAC 2005-83 are incorporated. The Naval Medical Logistics Command intends to award a contract on a brand name or equal basis for the following: Speed Mixer manufactured by Hauschild Engineering, Waterkamp 1, 59075 Hamm, Germany. This procurement will be classified under North American Industry Classification System (NAICS) 333999 with a Small Business Size Standard of 500 employees. The technical documentation for offerors proposal of "equal" models must meet the salient physical, functional and performance characteristics described below. "Equal" models are required to provide sufficient descriptive literature in accordance with FAR Clause 52.211-6, Brand Name or Equal, to allow for thorough evaluation of "equal" quotes. Specifically, the Speed Mixer shall conform to the following Salient Characteristics: Salient Characteristics: Speed variable: 300 - 3500 rpm Mixing time: 5 seconds to 5 minutes Mixing capacity: 5 grams to 100 grams Ability to plug into a standard, 125V, electrical outlet Input power: 490 Watts Imbalance sensor Automatic shut off due to excessive vibration Equipment: Variable speed settings, two fixed settings, viewing window, Tachometer, motor cooling fan Mixing never incorporates air Additional mixing time removes air from the blend Ability to mix directly into syringes and cartridges Maximum batch weight is 100 grams (150 grams total, including the mixing cup, lid and holder) The following brand name items are required: (1)P/N: 7004K Description: DAC 1501.FVZ-K Speed Mixer Quantity: 1 (2)P/N: 501 121 Description: Max 100 Holder Quantity: 1 (3)P/N: 501 122 Description: Max 60 Holder Quantity: 1 (4)P/N: 501 123 Description: Max 40 Holder Quantity: 1 (5)P/N: 501 124 Description: Max 20 Holder Quantity: 1 All of the above equipment and accessories shall be new from the manufacturer, Hauschild Engineering. Used or refurbished equipment, or equipment obtained from a third party shall not be accepted. Shipping Address: 8955 Wood Road, Bldg 1, Bethesda MD 20889 INSTRUCTIONS TO OFFERORS: This section specifies the format and content that Quoters shall use in this Request for Quote (RFQ). Quoters shall submit a quote that is legible and comprehensive enough to provide the basis for a sound evaluation by the Government. Any quote which does not provide, as a minimum, that which is required in the solicitation may be determined to be substantially incomplete and not warrant any further consideration. Technical • The Quoter shall include information to enable the evaluation of the proposed product and its conformance to the specified brand name or equal product by part number, manufacturer and description. Equipment offered as equal to brand name shall meet at a minimum the salient characteristics described in this solicitation, and the quoter shall provide descriptive literature in sufficient detail to determine if the items quoted are technically acceptable. Price • The Quoter shall provide pricing for all line items and a total contract price (all line items). • All pricing will be based on F.O.B Destination within the Continental U.S. • The proposed price will be evaluated by the Government and must be determined to be fair and reasonable for award. Other Administrative Instructions • The Quoter shall complete and submit DFARS Provision 252.209-7999 Representation by Corporations Regarding an Unpaid Delinquent Tax Liability or a Felony Conviction under any Federal Law-Fiscal Year 2015 Appropriations. • Contractors must be registered in the System for Award Management (SAM) database at time of award. Registration is free and can be completed on-line at https://www.sam.gov/portal/public/SAM/. • Provide DUNS number, Cage Code, and TIN Format of submission for "equal" proposals shall be separated into three sections, Technical, Price and Other Administrative.. Format of Submission for "brand name" shall be separated into two sections, price and Other Administrative. EVALUATION CRITERIA: This requirement will be evaluated as a Lowest Price Technically Acceptable (LPTA) requirement. Award will be made on the basis of the lowest evaluated price of quotes that meet or exceed the non-cost factors. The Government anticipates award of a firm fixed price (FFP) contract. The Government intends to evaluate quotes and award a contract without discussions, but reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government reserves the right to make no award as a result of this solicitation. The quoter with the lowest overall quoted price and determined technically acceptable will receive an award and no further offers will be evaluated. Technical: Evaluation shall include the ability to meet the brand name or equal of this requirement. Quoter's not meeting all requirements will not be further considered for award unless there are no other technically acceptable offerors. Price Reasonableness: The degree to which the Quoter's total proposed price represents a fair and reasonable price, including any additional components that must be purchased to make the system fully functional. Completeness: Quoters have included pricing for all line items, registered in SAM at time of award and acknowledgement of all amendments. Past Performance will not be an evaluation factor for this requirement. CLAUSES and ADDITIONAL INFORMATION: Companies shall also comply with DFARS 252.232-7003, ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (JAN 2004). PROVISIONS at FAR 52.212-1, Instructions to Offerors---Commercial Items, apply to this acquisition with the exception of (d), (h), and (i) of the clause, which are RESERVED. Offeror shall include a completed copy of provision at FAR 52.212-3, Offeror Representations and Certifications-Commercial Items, with their quote. Offeror shall include a completed copy of provision at DFARS 252.212-7000, Offeror Representations and Certification-Commercial Items. Addenda to this provision includes DFARS 252.225-7000, Buy American Act-Balance of Payments Program Certificate; 252.225-7006, Buy American Act-Trade Agreements-Balance of Payments Program Certificate; and 252.225-7035, Buy American Act--North American Free Trade Agreement Implementation Act--Balance of Payments Program Certificate. FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition.
