Description
Specifications Schedule of Items Furnish all labor, materials and equipment necessary to furnish, deliver and tailgate spread stone on six NFSR Forest Service roads located on the Cumberland Ranger District of the Daniel Boone National Forest in Bath, Menifee, Powell, Rowan and Wolfe Counties, Kentucky as indicated on the attached Schedule of Items and in accordance with the attached Section 813 Spot Surfacing specifications. Deliveries will be coordinated with the Contracting Officer's Representative (COR). This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This solicitation is issued as a Request for Quotation (RFQ) and the documents incorporate provisions and clauses in effect through Federal Acquisition Circular 2005-83. This procurement is set aside for small business. The NAICS code is 212312 and the Small Business Size Standard is 500 employees. The following FAR clauses and provisions apply to this solicitation. Those that are incorporated by reference can be viewed in full text at https://www.acquisition.gov/far 52.212-1 Instructions to Offerors - Commercial Items (APR 2014) 52.212-2 Evaluation - Commercial Items (OCT 2014) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: 1. Price: Governments evaluation will include the total cost to furnish, deliver and tailgate spread the stone. 2. Past Performance Any award resulting from this solicitation will be a firm, fixed price contract. Price is more important than past performance in the evaluation process. (b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. 52.212-3 Offeror Representations and Certifications-Commercial Items (MAR 2015) (The Offeror must complete this certification online electronically via the System for Award Management (SAM) website accessed through http://www.acquisition.gov or print this clause in full, complete the appropriate blocks, and submit with your offer.) AGAR 452.209-70 REPRESENTATION BY CORPORATIONS REGARDING AN UNPAID DELINQUENT TAX LIABILITY OR A FELONY CONVICTION ALT 1 (DEVIATION 2012-01) (FEB 2012) (a.) Awards made under this solicitation are subject to the provisions contained in the Consolidated Appropriations Act, 2012 (P.L. No. 112-74), Division E, Sections 433 and 434 regarding corporate felony convictions and corporate federal tax delinquencies. To comply with these provisions, all offerors must complete paragraph (1) of this representation, and all corporate offerors also must complete paragraphs (2) and (3) of this representation.
