- INTRODUCTION: THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institutes of Health (NIH), National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA), intends to negotiate and award a purchase order on a sole source noncompetitive basis to Waters Corporation, 34 Maple Street, Milford, MA, 01757-3604, to perform a high performance liquid chromatography system upgrade for the PET Radiochemistry Group in the National Institute of Biomedical Imaging and Bioengineering (NIBIB). BACKGROUND: The mission of the National Institute of Biomedical Imaging and Bioengineering (NIBIB) is to improve health by leading the development and accelerating the application of biomedical technologies. The Institute is committed to integrating the physical and engineering sciences with the life sciences to advance basic research and medical care. This is achieved through: research and development of new biomedical imaging and bioengineering techniques and devices to fundamentally improve the detection, treatment, and prevention of disease; enhancing existing imaging and bioengineering modalities; supporting related research in the physical and mathematical sciences; encouraging research and development in multidisciplinary areas; supporting studies to assess the effectiveness and outcomes of new biologics, materials, processes, devices, and procedures; developing technologies for early disease detection and assessment of health status; and developing advanced imaging and engineering techniques for conducting biomedical research at multiple scales. The NIBIB/ PET Radiochemistry Group conduct research on the development and validation of novel radiopharmaceuticals. HPLC systems are critical instruments for our research. These HPLC systems are used in our lab for purification and quality control of radiolabeled pharmaceuticals and also used for purification of synthetic peptides. The group is expanding to new areas of research. The laboratory requires an upgrade is needed for two of the current HPLC to meet the demand of an increased workload. PROCUREMENT: The system upgrade will include the following: • Empower Software w/ Buslace - Quantity - One (1) • Workstation W/S - CDS C30-1136 - Quantity - One (1) • Prep 150 LC System - Quantity - One (1) ANTICIPATED PERIOD OF PERFORMANCE: To be negotiation upon award JUSTIFICATION: The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10-Market Research. Only one source is reasonable available to perform the requested services to meet the Government's requirements. Waters is the only company that can provide the software and hardware upgrade and ensure complete compatibility with the remaining components of the system. REGULATORY AUTHORITY: This acquisition is conducted under the authority of the Federal Acquisition Regulations (FAR) Subpart 13.106-1(b) Soliciting from a single source, only one responsible source and no other supplies or services will satisfy agency requirements. ADDITIONAL INFORMATION: Industry Classification (NAICS) Code is 334516, Analytical Laboratory Instrument Manufacturing and the Small Business Size Standard is 500 Employees. This acquisition is conducted in accordance with the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures. The solicitation document, the incorporated provisions and clauses are those in the Federal Acquisition Circular 2005-83, effective August 3, 2015. This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by August 31, 2015 at 12:00 p.m. EST.
