- Justification - Brand Name This is a combined synopsis/solicitation for commercial items prepared in accordance with the format at FAR Subpart 12.6., as supplemented with additional information included in this notice, and it being conducted pursuant to FAR 2005-82 dated May 7, 2015 Part Subpart 12.6 and FAR Part 13. The Request for Quote (RFQ) number is GF133E-15-RQ-1092. The Government intends to purchase Hewlett Packard, pursuant to FAR 13.106-1(b) and 13.106-3(b)(3)(i) the circumstances of this acquisition deem there are limited sources available due to brand name requirement. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; QUOTES ARE BEING REQUESTED AND A WRITTEN SOLICITATION WILL NOT BE ISSUED. This procurement action is a total small business set-aside, NAICS Code 541519, Size Standard 150 empoyees. In order to participate, the vendor shall be an authorized reseller of Hewlett Packard. All responsible sources may submit an offer which shall be considered by the agency. However, any award from this RFQ will require the potential vendor to be certified within the System for Award Management (SAM) Databases prior to award. This justification and approval is for VMS and Tru64 software and technical support for NOAA. The use of a brand name description is essential to the Government's requirements, for OSPO infrastructure connectivity requirements, thereby precluding consideration of the products of another company. 1.Introduction/Background The Office of Satellite and Product Operations (OSPO) is responsible for the management and operations of the Satellite Operation Control Center (SOCC) and the Environmental Satellite Product Center (ESPC). The SOCC manages and directs the operation of NOAA's satellites and the acquisition of remotely sensed data. The Office has operational responsibility for the Satellite Operations Control Center (SOCC) at Suitland, MD and Command and Data Acquisition (CDA) facilities at Wallops, VA and Fairbanks, AK to command and control the satellites, to track the satellites, and to acquire their data. GOES satellites provide the kind of continuous monitoring necessary for intensive data analysis. The POES satellite system offers the advantage of daily global coverage, by making nearly polar orbits roughly 14 times daily. The Defense Meteorological Satellite Program (DMSP), low, earth-orbiting satellites have provided the military with important environmental information. DMSP satellites "see" such environmental features as clouds, bodies of water, snow, fire, and pollution in the visual and infrared spectra. Computer systems which are used to execute custom Telemetry and Command application programs are based upon the OpenVMS and Tru64 operating systems, products of the Hewlett-Packard Company (HP). While the OSPO Systems Branch does maintain a high level of expertise on these systems, there are instances where more detailed knowledge is necessary to resolve unusual operating system and/or VMS Layer Product behaviors and /or problems. 2.Scope of Work The desired support structure will resolve Tru64 and VMS Operating System and Layered Product Application problems in a timely and effective manner which ensures maximum system availability. A US on-shore support source will provide a realistic, time-coordinated means of communication between OSPO and the support facility. Support should meet the following guidelines with the understanding that these are air gapped systems: 3.Product Specifications I. Provide an equivalent or better direct replacement of HP Software Technical Unlimited Support, on a 24x7 schedule, which includes a minimum assistance in the following areas •System startup/shutdown sequences •Network device configuration •Backup and restore processes •General troubleshooting of the OS and Layered Products •Crash dump analysis •Performance recommendations •Language compiler use and error diagnostics •System/file/user security management parameters •Remote and local storage configuration and maintenance ex. SANS II. Call Management: Clear, concise and direct communications are key factors: •Eliminate phone menu systems to the greatest extent possible •Typical response within 2 hours of initial call •Initiate problem tracking upon first call contact •Provide progress updates as the problem is being worked •Make problem report summary available upon request •Allow for multiple points of contact to access vendor resources III. Technical experience in Tru64 and OpenVMS operating system and Layered Products •Technical account manager: average 20-25 years •Senior level technician: 15-20 years IV. Prior and Current Version Support - Be able to provide technical support of all versions of OpenVMS VAX, OpenVMS Alpha and OpenVMS I64, from v6.2 to and including the currently shipping version, and Tru64 and to include patches and updates. 4.Product Specifications Continued 24X7 Telephone support and maintenance for VMS and TRU64 applications 5.Price Consideration Shall be separately provided for each year, base and all option periods 1 YearVMS / TRU64 HP Software Technical Unlimited Support, on a 24x7 schedule Firm Fixed Price for product specifications 6.Requested Delivery/Period of Performance Requested Delivery: 09/12/2015 Period of Performance: Base Year:09/12/2015-09/11/2016 Option Year 1:09/12/2016-09/11/2017 Option Year 2:09/12/2017-09/11/2018 7.Security Requirements, if any The contractor shall comply with the IT Security requirements of the Department of Commerce as outlined in Commerce Acquisition Regulation (CAR) 1352.239-72, Security Requirements For Information Technology Resources (April 2010), except that development of a Security Authorization Package in accordance with CAR 1352.239-72, section (i) is not required. In addition, personnel shall be screened in accordance with the requirements for High Risk contracts as specified by CAM 1337.70 section 2.3; specifically, in accordance with CAR 1352.237-70, Security Processing Requirements-High or Moderate Risk Contracts (April 2010). The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 36 months. FAR clause 52.212-2, EVALUATION--COMMERCIAL ITEMS (OCT 2014) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (1) The offerors capability to successfully perform the contract (2) Price. (b) "Options." The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (End of Provision) 52.203-99, PROHIBITION ON CONTRACTING WITH ENTITIES THAT REQUIRE CERTAIN INTERNAL CONFIDENTIALITY AGREEMENTS (DEVIATION 2015-02) PROHIBITION ON CONTRACTING WITH ENTITIES THAT REQUIRE CERTAIN INTERNAL CONFIDENTIALITY AGREEMENTS (FEB 2015) (a) The Contractor shall not require employees or subcontractors seeking to report fraud, waste, or abuse to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information. (b) The contractor shall notify employees that the prohibitions and restrictions of any internal confidentiality agreements covered by this clause are no longer in effect. (c) The prohibition in paragraph (a) of this clause does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information. (d)(1) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Resolution Appropriations Act, 2015 (Pub. L. 113-235), use of funds appropriated (or otherwise made available) under that or any other Act may be prohibited, if the Government determines that the Contractor is not in compliance with the provisions of this clause. (1) The Government may seek any available remedies in the event the Contractor fails to comply with the provisions of this clause.
