- 1. Sole Source Justification 2. Authority FAR 13.106-1(b)(1) 3. The U.S. Department of Agriculture, Grain Inspection, Packers and Stockyards Administration, Technology and Science Division (GIPSA TSD) located at 10383 North Ambassdor, Kansas City, MO intends to award a 5-year Blanket Purchase Agreement (BPA) (NTE $60,000) to Praxair Distributing Inc., 39 Old Ridgebury Road, Danbury, CT, on a sole-source basis. This requirement consists of monthly rental for a 3000L liquid nitrogen tank system and liquid nitrogen tank refills on an as-needed basis. The requirement was previously competed in February 2011, and pricing was added to a previously awarded USDA BPA with Praxair to supply a variety of compressed laboratory gases (#AG-6395-B-09-0107). 4. The purpose of this BPA is to continue providing the GIPSA TSD facility with a 3000L liquid nitrogen tank system and liquid nitrogen tank refills on an as-needed basis. The existing system was plumbed into the lab facility during a 2011 re-construction project. The system uses high purity tubing and Swagelok fittings to provide a constant flow rate of at least 2000 scf/h and maintain pressure adequate to supply eight instruments that each require an inlet pressure of 100 psi. Consumption of nitrogen gas is estimated at 25,000 - 50,000 scf per month for the facility. On-site delivery of high purity liquid nitrogen into the microbulk system providing uninterrupted laboratory services is required. The tank level must be monitored by telemetry and refilled in order to maintain operating conditions. The nitrogen product from the vessel must be dry and oil-free with a purity of at least 99.998% purity%, CO2 < 10 ppm, H2 < 10 ppm, H2O < 10 ppm, O2 < 10 ppm, and THC < 1 ppm. The purity of the nitrogen is critical as contamination of analytical instrumentation and shutdown of laboratory services may result from the presence of impurities. 5. Re-competing this requirement and switching vendors would require shutting down the microbulk system, removal of the existing system, and installation and testing of new one, which would cause a significant and costly disruption to services provided by the Agency. 5. Fair and Reasonable Pricing Determination. The tank rental pricing and bulk liquid nitrogen pricing has remained the same since the requirement was first competed in February 2011. Praxair was selected as the low-cost provider at that time. Any future proposed prices increases would require a re-assessment of market conditions and another fair and reasonable pricing determination. 6. This notice is for informational purposes only. No formal solicitation will be issued. A determination by the Government not to compete with this intended BPA based on responses to this notice is solely within the discretion of the Government. Simplified procurement procedures per FAR 13 will be used as well as commercial item acquisition regulations per FAR 12.
