13 Aug 2015 MEMORANDUM FOR ALL INTERESTED PARTIES FROM: 36 CONS/LGCB Bldg 22026 Unit 14040 Andersen AFB, Yigo, GU 96929 1. This is a combined synopsis/solicitation for a commercial service prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. 2. FA5240-15-Q-M038 for Refurbish and Enhancement of CONEX Containers is hereby issued as a request for quotes. 3. The following solicitation document, incorporated provisions, and clauses are in effect through Federal Acquisition Circular 2005-83. 4. This solicitation has been set aside for 100% Small Business under the 561790 NAICS Code, with a small business size standard of $7,500,000.00. 5. *Notice to Offerors: Funds are not presently available for this project. No award will be made under this solicitation until funds are available. The Government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an offeror for any costs incurred as a result of this request for proposal. 6. The government request quotes for the following service (see attached Statement of Work for details); CLIN DESCRIPTION QTY PRICE 0001 One time service to refurbish and enhance 16 containers and 2 pedestrian bridges in accordance with the attached statement of work. 1 Lot 7. All services are to be performed at: Unit 14048 North-West Field, Andersen AFB Yigo, Guam 96929 8. The provision 52.237-1, Site Visit applies to this acquisition - Offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award SITE VISIT: A site visit will be conducted on 24 August 2015 at 1000. Contractors interested in attending the site visit must contact SSgt Matthew Rowe, matthew.rowe.1@us.af.mil, 671-366-2358, to make arrangements to attend the site visit. The provision at FAR 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition along with its addendum: 10. ADDENDUM TO FAR 52.212-1: (a) The contractor shall submit their quote on company letterhead to include the following: solicitation number, contact name, address, telephone number of the offeror, unit price, extended price, any discount terms, delivery terms, cage code, DUNS number, tax identification number, size of business, and acknowledgement of solicitation amendments, if required. Quotes are not to exceed 10 pages in length, exclusive of past performance information, offeror's representations and certifications, and the written continuation of essential contractor services plan required by provision DFARS 252.237-7024. (b) Quotes and past performance information must be received no later than 4:00 p.m. Chamorro Standard Time (ChST), 18 September 2015, Quotes must be submitted via e-mail to the Primary POC. FAX submissions will not be accepted. Oral offers will not be accepted. Offers received after this date and time will be considered late in accordance with FAR 52.212-1(f) and may not be considered in accordance with FAR 52.212-1(f)(2)(i). (c) To assure timely and equitable evaluation of the quote, the offeror must follow the instructions contained herein. Offerors are required to meet all solicitation requirements. Failure to meet a requirement may result in an offer being ineligible for award. The response shall consist of two (2) separate parts; Part I - Price Quote, Part II Past Performance Information. (d) The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer's opinion, adequate price competition exists no additional cost information will be requested. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit information to the extent necessary for the contracting officer to determine price reasonableness. (e) Specific Instructions: PART I - PRICE QUOTE - Submit on company letterhead the unit price for each line item to include extended price with an overall total price. a. In accordance with FAR 52.212-4(t), System for Award Management (SAM) contractors must be registered with SAM to conduct business with the Department of Defense. No purchase order can be awarded to any company without this registration (www.sam.gov). b. Offerors shall provide a written statement that the offeror's quote incorporates all amendments to the solicitation (if applicable). c. Quotes must be firm-fixed price. PART II- PAST PERFORMANCE INFORMATION - Present and past performance information will be used to determine satisfactory performance of the services proposed. (a) The offeror shall submit evidence from a minimum of two (2) recent and relevant past performances that have used or are currently using the same or similar services proposed for this contract. The offeror shall include a list of the relevant customers (including contact information) in their quote. (b) Provide information currently available (letters, metrics, customer surveys, independent surveys, etc.) which demonstrates customer satisfaction with overall job performance and quality of completed product for same or similar type contract. In addition, explain corrective actions taken in the past, if any, for substandard performance and any current performance problems such as cost overruns, extended performance periods, etc. (c) Past Performance Information: The Government will evaluate the quality and extent of an offeror's performance deemed relevant to the requirements of this solicitation. The Government will use information submitted by the offeror and other sources such as other Federal Government offices and other military installations to assess performance. Relevancy is defined as: Relevant - Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires. Not Relevant - Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires. If a teaming arrangement is contemplated, identify the work the subcontractor will be performing if you are relying on the subcontractor's past performance. (d) Subcontractor Consent: Past performance information pertaining to a subcontractor cannot be disclosed to the prime offeror without the subcontractor's consent. Provide with the quote a letter from all subcontractors that will perform major or critical aspects of the requirement, consenting to the release of their past performance information to the prime contractor. (e) Contracts older than three years will not be considered. 11. The provision at FAR 52.212-2, Evaluation - Commercial Items, applies to this acquisition along with its addenda: ADDENDUM TO FAR 52.212-2 (a) The Government intends to award a contract resulting from this solicitation to the responsible offeror whose proposal conforming to the solicitation will be most advantageous to the Government with price and past performance considered. The following factors shall be used to evaluate offers: Price and Past Performance. Past Performance shall be graded on an "acceptable or unacceptable" basis. The following table details what will deem an "acceptable" or "unacceptable" rating: PAST PERFORMANCE ASSESSMENT TABLE Rating Description ACCEPTABLE Based on the offeror's past performance and record, the Government has a reasonable expectation that the offeror will successfully perform the required effort. UNACCEPTABLE Based on the offeror's past performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort. If the lowest priced quote has a past performance of unacceptable, the Government will evaluate the next lowest offeror and so on until an awardee is identified. The award will be made to the lowest evaluated price with an acceptable past performance assessment. Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, "unknown" shall be considered "acceptable." (b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. 12. FAR 52.212-3 Offeror Representations and Certifications -- Commercial Items applies to this acquisition. This means that the contractor must have a valid Representations and Certifications filed in the System for Award Management (SAM) or provide the government a completed copy of the record. 13. FAR 52.212-4 Contract Terms and Conditions -- Commercial applies to this acquisition. 14. FAR 52.212-5 Contract Terms and Conditions Required To Implement Statutes Or Executive Orders -- Commercial Items (DEVIATION 2013-O0019) applies to this acquisition. 15. FAR 52.216-1 Type of Contract The Government contemplates award of a Fixed-Firm Priced contract resulting from this solicitation. 16.
