DESCRIPTION: THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN ACCORDANCE WITH THE FORMAT IN FAR SUBPART 12.6-STREAMLINED PROCEDURES FOR EVALUATION AND SOLICITATION FOR COMMERCIAL ITEMS-AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; QUOTATIONS ARE BEING REQUESTED, AND A SEPARATE WRITTEN SOLICITATION DOCUMENT WILL NOT BE ISSUED. THE SOLICITATION IS BEING ISSUED USING SIMPLIFIED ACQUISITION PROCEDURES. This solicitation is a Request for Quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-83, Effective 25 Aug 2015. 1352.215-72 INQUIRIES (APR 2010) Offerors must submit all questions concerning this solicitation in writing to the Contracting Officer. Questions should be received no later than five calendar days after the issuance date of this solicitation. Any responses to questions will be made in writing, without identification of the questioner, and will be included in an amendment to the solicitation. Even if provided in other form, only the question responses included in the amendment to the solicitation will govern performance of the contract. (End of provision) The associated North American Industrial Classification System (NAICS) code for this procurement is 333911- Pump and Pumping Equipment Manufacturing with a small business size standard of 500 employees. This requirement is unrestricted and all interested Offerors may submit a quotation. Introduction The contractor shall furnish the necessary personnel, material, equipment, and services to fabricate SIX (6)-Edwards STP - iXR1606 or equivalent. A high capacity dry vacuum turbo pump is necessary to allow quick evacuation of the detector vessel and to achieve and maintain low ultimate pressure. Background The NIST Center for Neutron Research (NCNR) is continuously developing new and better instruments for neutron scattering. The present purchase is for six (6) higher capacity dry turbo vacuum pumps. Four (4) are for the new Very Small Angle Neutron Scattering (VSANS) detector vessel which will be installed at NG-3. Two (2) of these pumps will be used in the deuterium refrigerator project. This vessel will need to run continuously to keep reactor running. The pumps must be Edwards iXR1606 or equivalent. ALL ITEMS MUST BE NEW. NO PROTOYPES, DEMONSTRATION MODELS, USED, REFURBISHED OR REMANUFACTORED EQUIPMENT, PARTS OR COMPONENTS WILL BE CONSIDERED FOR AWARD. All Offerors shall provide a quotation for the following line item: Line Item 0001: SIX (6) Higher Capacity Dry Turbo Vacuum Pumps (Edwards STP - iXR1606 or equivalent pumps) The pumps shall meet or exceed the following salient characteristics: 1) Maximum overall body dimensions: Height: 15" Length: 15" Width: 15" 2) Minimum Inlet flange size: ISO 200 - If inlet flange is larger than ISO 200, an adaptor to ISO 200 must be provided. The adaptor will add to the overall length of the pump which cannot exceed the above dimensions. 3) Power source: 220V, Single phase 4) Current consumption: Equal or less than 30A 5) Pump type: Dry (oil free) 6) Cooling: Air or Water cooled If water cooled flow requirements: 3.0 Liters/minute 7) Minimum peak pumping speed: 1500 L/s 8) Ultimate Pressure: 1 X 10^-7 Torr 9) Maximum weight: 50 Kg 10) Installation position: Shall be able to be mounted horizontally 11) Low maintenance: No anticipated or scheduled maintenance needed for 5 year of continuous use. 12) The system must be able to evacuate the VSANS detector vessel (3460 cu-ft; 45 inches diameter X 940 inches long) to 1X10^-3 Torr in less than 3.5 hours. 13) Pump down curves must be provided by Vendor under the following guidelines: a. Compatible with NIST's existing Edwards GXS250/2600 as rough pump b. The pump down curve provided must be calculated for VSANS detector vessel. Dimensions for said vessel are provided on specification #12 of this solicitation. The VSANS detector vessel will be lined with boraflex shielding (0.080" thick). c. Perform pump down curve for only 3 pumps. 14) Edwards Part # YT79U1Z00 (iDT-001); Display Terminal Unit with 3m cable for use with STP-iXR-1606, or Equivalent; a. The iDT display unit operates the pump, confirms the pump status or sets various settings. b. Equipped with an LCD screen and flat panel switches. 15) Edwards Part # YT79Y0A00- Power cable terminal 5m for use with STP-iXR series, or Equivalent shall be compatible with STP-iXR-1606. NOTE: Out of the 6 pumps being purchased in this solicitation, 3 will be used for the VSANS detector vessel, 2 will be used with the deuterium refrigerator project, and 1 will be a house spare. WARRANTY: The pumps shall be warrantied for one year for all parts and labor, and shipping. INSTALLATION: Onsite installation and demonstration shall be done by NIST at NIST, Gaithersburg, MD - Building 235. Final acceptance testing shall occur within 30 days after installation. DELIVERY: Delivery shall be FOB DESTINATION and shall take place 12 weeks from ARO unless mutually agreed upon the Government's ability to receive earlier. The Contractor shall initially deliver the systems to NIST, Building 301, Shipping and Receiving, Gaithersburg, MD 20899-1640 prior to an ultimate delivery at the Loading Dock for Building 235. INSPECTION AND ACCEPTANCE: In addition to the inspection and acceptance terms articulated in 52.212-4, the Government reserves the right to perform such performance tests and evaluations to verify specified system performance. The Contractor has the right to be present during the tests and evaluations, if performed, at the Contractor's expense. Final acceptance testing shall occur within 30 days after installation. PROVISIONS AND CLAUSES: The following provisions and clauses apply to this acquisition and are hereby incorporated by reference. Representation by Corporations Regarding an Unpaid Delinquent Tax Liability or a Felony Conviction Under Any Federal Law (Class Deviation) (March 2015) (1) In accordance with Sections 744 and 745 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), none of the funds made available by the Consolidated and Further Continuing Appropriations Act, 2015 funding may be used to enter into a contract with any corporation that- (a) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where an awarding agency is aware of the conviction, unless the agency has considered suspension or debarment of the corporation and has made a determination that this further action is not necessary to protect the interests of the Government, or (b) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless the agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government. L. 113-235), Government agencies are not permitted to use funds appropriated (or otherwise made available) under that or any other Act for contracts with an entity that requires employees or subcontractors of such entity seeking to report fraud, waste, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information. (b) The prohibition in paragraph (a) of this provision does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information. L. 113-235), none of the funds made available by Consolidated and Further Continuing Appropriations Act, 2015 and subsequent appropriations acts may be used to enter into a contract with any corporation that - (a) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where an awarding agency is aware of the conviction, unless the agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government, or (b) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless the agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government. (End of clause) 52.203-99, Prohibition on Contracting with Entities that Require Certain Internal Confidentiality Agreements (DEVIATION 2015-02) PROHIBITION ON CONTRACTING WITH ENTITIES THAT REQUIRE CERTAIN INTERNAL CONFIDENTIALITY AGREEMENTS (FEB 2015) (a) The Contractor shall not require employees or subcontractors seeking to report fraud, waste, or abuse to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information. Refusal to register shall forfeit award. Due Date for Quotations Offerors shall submit their quotations so that NIST receives them not later than 4:00 p.m. Eastern Time on SEPTEMBER 8, 2015. FAX copy quotations shall not be accepted. E-mail quotations shall be sent to Harry.Brubaker@nist.gov. Offerors quotations shall not be deemed received by the Government until the quotation is entered into the e-mail address inbox set forth above. Quotations shall be sent to the National Institute of Standards and Technology, Acquisition Management Division, Attn: Harry Brubaker, Contracting Officer; 100 Bureau Drive, Stop 1640; Gaithersburg, MD 20899-1640. All Offerors should ensure the RFQ number is visible on the outermost packaging. Because of heightened security, FED-EX, UPS, or similar delivery methods are the preferred method of delivery of quotes. ADDENDUM TO FAR 52.212-1, QUOTATION PREPARATION INSTRUCTIONS 1) PRICE QUOTATION: The Offeror shall submit an original and one copy of the completed price schedule. Only one copy is required if submitted electronically. The pricing quotation shall be separate from any other portion of the quotation. The Offeror shall propose a firm-fixed-price, FOB Destination, for each CLIN. Contractor shall state express warranty coverage. Price quotations shall remain valid for a period of 90 days from the date quotations are due. 2) TECHNICAL QUOTATION: The Offeror shall submit an original and one copy of the technical quotation. Only one copy is required if submitted electronically. The technical quotation shall address the following: TECHNICAL CAPABILITY: The Offeror shall provide documentation that demonstrates that the equipment shall be capable of meeting or exceeding the minimum requirements to include the following: a. Technical description and/or product literature which clearly details the manufacturer, make and model of the proposed product(s), addresses all required specifications, and clearly documents that the offered product(s) meet(s) or exceeds the specifications stated herein; b. If standard product literature and/or technical descriptions do not address all required specifications, Offerors must provide narratives and or explanation of the work that will be performed to meet the requirement(s). All proposed work must be addressed in sufficient detail that all technical requirements are discussed and that the intended outcome of the work can be clearly discerned. If applicable, evidence that the Offeror is authorized by the original equipment manufacturer to provide the item(s) in the quotation should be included. ACCEPTANCE OF TERMS AND CONDITIONS (ADDENDUM TO FAR 52.212-1 (B) (11)): THIS IS AN OPEN-MARKET SOLICITATION FOR EQUIPMENT AS DEFINED HEREIN. THE GOVERNMENT INTENDS TO AWARD A PURCHASE ORDER AS A RESULT OF THIS SOLICITATION THAT WILL INCLUDE THE CLAUSES SET FORTH HEREIN. THE QUOTATION SHOULD INCLUDE ONE OF THE FOLLOWING STATEMENTS: "The terms and conditions in the solicitation are acceptable to be included in the award document without modification, deletion, or addition." OR "The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following: Offeror shall list exception(s) and rationale for the exception(s) Note: This procurement is not being conducted under the GSA Federal Supply Schedule (FSS) program or another Government-Wide Area Contract (GWAC). If an Offeror submits a quotation based upon an FSS or GWAC contract, the Government will accept the quoted price. However, the terms and conditions stated herein will be included in any resultant Purchase Order, not the terms and conditions of the Offerors FSS or GWAC contract, and the statement required above shall be included in the quotation. QUOTATION EVALUATION: EVALUATION FACTORS: Award shall be made to the Offeror whose quotation is lowest price technically acceptable to the Government. The Government will evaluate quotations based on the following evaluation criteria: 1) Technical Capability and 2) Price. TECHNICAL CAPABILITY: All items must be new. Prototypes, used or refurbished instruments will not be considered for award. Evaluation of technical capability shall be based on the information provided in the quotation. NIST will evaluate whether the Offeror has demonstrated that its proposed equipment meets or exceeds all minimum requirements. Quotations that do not demonstrate the proposed equipment meets all requirements will not be considered further for award. If an Offeror does not indicate whether its proposed equipment meets a certain minimum requirement, NIST will determine that it does not. PRICE: The Government will evaluate price for reasonableness. 1352.233-70 AGENCY PROTESTS (a) An agency protest may be filed with either: (1) the contracting officer, or (2) at a level above the contracting officer, with the appropriate agency Protest Decision Authority.
