- The Defense Logistics Agency, DLA Maritime Norfolk, Norfolk Naval Shipyard Contracting Division, intends to negotiate a Firm Fixed Price contract for one year to procure Argon 75% and Helium 25% mix and rental of gas cylinders to be delivered to the Norfolk Naval Shipyard, Portsmouth. The North American Industry Classification System (NAICS) code is 325120 (Industrial Gases: Compressed & Liquefied) and the procurement will be 100% set aside for small businesses. The contract line items are as follows: CLIN 0001: ARGON 75% HELIUM 25% Estimated period of performance is 28 September 2015 through 27 September 2016 Delivery as required within 24 hours of notification, pay for on as a needed basis; contract not to exceed 300,000 CU. FT. Cylinder size shall be 235 to 336 CU. FT. NSN: 9B 6830 LL-N03-8962 All material for this line item must be marked and identified clearly on each individual container and LABEL IAW CFR 29.1910.1200. MATERIAL DATA SAFETY SHEET REQUIRED WITH MATERIAL MUST NOT CONTAIN "METHYLENE CHLORIDE" If another manufacturer and product is offered, vendor is required to provide a copy of the material safety data sheet for review. CLIN 0002: GAS CYLINDER RENTAL Estimated period of performance is 28 September 2015 through 27 September 2016 Contract not to exceed 900 cylinders per year and not to exceed 100 cylinders at one time. Full cylinder delivery is required within 24 hours of notification. SPECIFICATION OF WORK 1.1 SCOPE 1.2 Scope. This specification provides the minimum requirements for 75% Argon 25% Helium gas mixture and cylinder rental. 2.1 APPLICABLE DOCUMENTS 2.2 Government Documents. The following documents of the issue in effect on the date if invitation for bids or requests for proposal form a part of the specification to the extent specified herein. SPECIFICATIONS MILITARY: MIL-STD-1 29- marking for Shipment and Storage OTHER GOVERNMENT AGENCY U.S. DEPARTMENT OF LABOR OSHA 2206- General Industry, OSHA Safety and Health Standards, 29 CFR 1910 2.2 Non-government documents. The following documents for a part of this specification to the extent herein. Unless otherwise indicated, the issue in effect on the date of invitation for bid or request for proposal shall apply. STANDARDS AMERICAN SOCIETY FOR TESTING AND MATERIALS (ASTM) ASTM-D-3591 - Standard Practice for Commercial Packaging (Application for copies should be addressed to: American Society for Testing Materials, 1916 Race Street, Philadelphia, PA 19103.) NATIONAL FIRE PROTECTION ASSOCIATION (NFPA) NFPA-70-1987 -National Electrical Code (Applications for copies should be addressed to: National Fire Protections Association, Battery march Park, Quincy, MA 02269.) 2.3 Order of Precedence. In the event of conflict between the test of this specification and the references sited herein, the text of the specification shall take precedence. However, nothing in this specification shall supersede applicable laws and regulations unless a specific exemption has been obtained. 3.0 REQUIREMENTS. 3.1 75% Argon 25% Helium 3.1.1 Contract requirement is for deliveries of 75% Argon 25% Helium, on an as needed basis, unless otherwise requested by the Government point of contact (Will be provided at time of award), located at Norfolk Naval Ship Yard, Portsmouth, VA 23709. The contractor shall respond to the request for delivery within 24 hours of government notification. The terms of this contract requirement shall be from 28 September 2015 through 27 September 2016. 3.1.2 The contract requirement is not to exceed a total of 300,000 Cu. Ft. per year. The contractor shall make as needed deliveries of full cylinders while picking up empties. The quantity of mixed gas listed within this solicitation is an estimate and shall not be exceeded without the prior approval of a contracting officer. The Government shall only invoice for the actual amount of Gas and Cylinders delivered under the contract period. Prior to payment invoices will be certified/verified by point of contact given at time of award. 3.1.3 The Government reserves the right to refuse any delivery which, after being tested by qualified government personnel, does not conform to the requirements of Type I Purity as set-forth in MIL­ PRF-O-27210G. 3.3 Rental cylinders 3.3.1 The contractor shall provide rental no more than 900 cylinders per year not to exceed 100 cylinders at a time. The cylinder size will be between 235 and 336 Cu. Ft. The rental period shall be from 28 September 2015 through 27 September 2016. The contractor's price shall include the cost of delivery and pick up of empties. Unless otherwise specified in the contract or purchase order, the contractor is responsible for the performance of all inspection requirements (examinations and tests) as specified herein. Except as otherwise specified in the contract or purchase order, the contractor may use his or her own or any facilities suitable for the performance of the inspection requirements specified herein, unless disapproved by the government. The government reserves the right to perform any of the inspections set forth in this specification where such inspections are deemed necessary to ensure supplies and services conform to prescribed requirements. 4.1.1 Responsibility for Compliance. All items shall meet all requirements of Sections 3 and 5. The absence of any inspection requirements in the specification shall not relieve the contractor of the responsibility of ensuring that all products or supplies submitted to the government for acceptance comply with all requirements of the contract. The solicitation number will be SPMYM1-15-Q-0123.
