- Requirements Brand Name Justification This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. The Request for Quotation/solicitation number is ITC-RFQ-15-0075. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-84. This procurement is a Total Small Business set aside. The associated North American Industrial Classification System Code (NAICS) for this procurement is 423430, Computer and Computer Peripheral Equipment and Software Merchant Wholesalers, with the small business size standard of 100 employees. The U. S. International Trade Commission (USITC or Commission) requires Niksun Software Upgrade and Maintenance Licenses (see the attached requirements). The period of performance is for 12 months from date of award. The selected Offeror must comply with the following commercial item terms and conditions, which are incorporated herein by reference: FAR 52.212-1, Instructions to Offerors - Commercial Items; FAR 52.212-3, Offeror Representations and Certifications - Commercial Items; FAR 52.212-4, Contract Terms and Conditions-Commercial Items; and FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, Paragraph (a), and the following clauses in Paragraph (b): 52.204-10; 52.209-6; 52.219-6; 52.219-28; 52.222-3; 52.222-19; 52.222-21; 52.222-26; 52.222-36; 52.222-50; 52.223-18; 52.225-13; 52.232-33. The full text of the referenced FAR clauses may be accessed electronically at https://www.acquisition.gov/far/. The USITC intends to award a Firm Fixed Price Purchase Order to the Offeror whose offer represents the Lowest Price/Technically Acceptable (LPTA) offer to the Government. Offerors must be (1) an authorized Niksun reseller and (2) registered and current in the SAM database (www.sam.gov) before an award may be made to them. Questions related to this solicitation must be received by Monday, September 14, 2015, by 12:00 PM, Eastern Time, sent to michael.pigram@usitc.gov. Quotations must be received on or before Wednesday, September 16, 2015, by 2:00 PM, Eastern Time, sent to michael.pigram@usitc.gov.
