- The United States Patent and Trademark Office (USPTO) has a continuing requirement for contractor support for a follow-on delivery order to Desk Flex, Inc. for the purchase of software and maintenance. The USPTO intends to negotiate and award a contract for Deskflex Software Maintenance, NAICS 511210 Software Publishers, to Desk Flex, Inc. for a period of one base year and two option years, with an estimated value of $55,588.32. The anticipated award date is 9/21/15. Market research has revealed that Desk Flex, Inc. is the only available source for the DeskFlex Software Maintenance. Market research has revealed that Desk Flex, Inc does not have any resellers and is the only source available for Deskflex software maintenance and creator of the proprietary content and technology contained therein. This is essential for Patent Examiners, additionally USPTO also confirmed that the product Suite is FedRAMP Compliant. As a result of the market research and USPTO's exemption from the Competition in Contracting Act, the subject requirement is being procured using the Alternative Competition Method in accordance with the Patent and Trademark Office Acquisition Guidelines (PTAG) and the Patent and Trademark Office Efficiency Act, 5 U.S.C. 2(b)(4)(A). This notice of intent is not a request for competitive proposals.
