- Sole Source Justification for BreakingPoint Notice of Intent to Award Sole Source The Marine Corps Tactical Systems Support Activity (MCTSSA), Camp Pendleton, CA, intends to issue a sole-source contract for the following highly specialized items that are only available from IXIA, Inc.: BreakingPoint License Renewal (H/W products) - Mfg part # 909-0855 - Qty 1 ea. BreakingPoint ATI License Renewal (S/W products) - Mfg part # 909-0856 - Qty 1 ea. BreakingPoint License Reinstatement Fee (H/W & S/W products) - Mfg part # 909-0418 - Qty 1 ea. Please refer to the attached J&A for more information. Based on extensive market research, and under the authority of FAR 6.302-1(a)(2)(ii), "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements" the Government intends to award a Firm-Fixed-Priced contract to IXIA, Inc.. This cost effective and administratively efficient action in effect is to avoid a substantial duplication of cost to the Government that is not expected to be recovered through competition at this time. This Notice of Intent is not a request for quotations or an announcement of a forthcoming solicitation. However, all quotes received will be considered by the Government. All interested sources must respond in writing with clear and convincing evidence to support their ability to provide timely and effective Maintenance Renewal Licenses for IXIA software, hardware, and operating system support. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. If no affirmative written response is received within three (3) days after publication of this notice, a sole-source contract to IXIA, Inc. will be issued.
