Description
On September 15, 2015, the Technology Acquisition Center awarded Delivery Order VA118-15-F-0481 under the terms and conditions of National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V contract NNG15SD23B with Government Acquisitions, Inc, 720 Pete Rose Way, Cincinnati, OH 45202. Government Acquisitions will be providing Cisco AppX add-on licenses. The period of performance shall be for 12 months, the total order value of $155,218.42. ? JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity: Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724 2. Description of Action: This proposed action is for the award of a brand name firm-fixed-price delivery order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC). 3. Description of the Supplies or Services: VA, Office of Information and Technology, Service Delivery and Engineering, Enterprise Systems Engineering has a requirement for 158 add-on Cisco ISR-G2 (2900 and 3900 series) router licenses and technical support. The licenses are for 16 existing Cisco 2900 and 142 existing 3900 series ISR-G2 routers. Once the licenses are installed on the routers, configuration commands will be available and will allow the routers to be configured to operate within the myVA wide area network (WAN) Multi-Protocol Label Switching (MPLS) over Multi-point Generic Routing Encapsulation (mGRE) architecture. These AppX add-on licenses are in the form of a text file and are downloadable (one per router) only from Cisco's website. The files when installed on the router will enable support for the configuration of Enterprise myVA WAN MPLS over mGRE technologies. The license key and text file does this by turning on specific commands sets within the router's existing operating system. This licensing is specific to Cisco ISR G2 routers. All required licenses shall be delivered no later than 30 calendar days after award. The technical support period of performance shall be 12 months from the date of acceptance of the licenses. 4. Statutory Authority: The statutory authority permitting this exception to fair opportunity is 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5. Rationale Supporting Use of Authority Cited Above: Based on market research, as described in section 8 of this justification, it was determined that Cisco or its authorized resellers are the only sources that can provide the required AppX licenses that will allow for the routers to be configured to operate within the myVA. VA currently owns 158 Cisco ISR-G2 routers running on Cisco Internetwork operating system (Cisco IOS). These routers must be reconfigured to be incorporated into the new myVA WAN. The AppX licenses (in the form of a text file) will unlock additional Cisco IOS software commands allowing the routers to be configured to operate in the new myVA WAN. Cisco owns the intellectual property rights to the licenses and is the only vendor that makes the software that can allow configuration of the existing routers. Without procuring these licenses the routers will not work on the myVA WAN. The purpose of investing in this license add-on is to leverage existing VA-owned hardware. This investment is a cost avoidance measure in lieu of having to purchase replacement hardware with the needed license keys and/or configuration features enabled. Replacement of these routers will cost the VA approximately $13,813 per router for a total cost of approximately $2,182,393.00 for 158 routers. This replacement cost estimate was derived from Independent Government Cost Estimate pricing gathered between July 2015 and August 2015 during the VA 2015 router refresh effort. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in section 8 of this justification. This effort did not yield any additional sources that can meet the Government's requirements. It was determined that limited competition is viable among authorized resellers for the required brand Cisco AppX add-on licenses. In accordance with FAR 5.301 and 16.505(b)(2)(ii)(D), notice of award of this action will be synopsized and this justification will be made publicly available within 14 days of award on the Federal Business Opportunities Page. In accordance with FAR 16.505(a)(4)(iii)(A), this justification will be posted with the request for quotation on the NASA SEWP V GWAC website to notify all interested parties. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be competed. 8. Market Research: The Government's technical experts conducted market research from April 2015 through May 2015 by performing extensive laboratory testing. The evaluation of the testing results led to the conclusion that in order for VA to leverage it's currently owned Cisco routers AppX license keys are a required to install on the existing Cisco ISR-G2 routers. This will allow VA to configure the routers to interoperate in the myVA MPLS over mGRE WAN in support of the myVA initiative. Since all license needs are specific to existing Cisco routers, and since Cisco owns the proprietary intellectual property rights for the required AppX license keys, additional market research was performed by reviewing Cisco documentation, direct testing on VA owned hardware using free temporary licenses, and discussions with Cisco Network Engineers. Ultimately, no other brand software is capable or authorized to run on the Cisco routers that VA owns. Based on all of these market research efforts, the Government's technical experts have determined that only Cisco's AppX license can meet all of VA's needs specific to the MPLS over mGRE WAN functionality required for the existing VA owned Cisco ISR-G2 2900 and 3900 series routers. Additional market research was conducted by the Contract Specialist in August 2015 by utilizing the Provider Lookup Tool to determine whether the brand name Cisco AppX add-on licenses are available on the NASA SEWP V GWAC. It was determined that there are several resellers of the required brand name Cisco AppX licenses that hold current contracts on the NASA SEWP V GWAC. Competition is anticipated among these GWAC holders. 9. Other Facts: None.
