- Sole Source Justification This is a Notice of Proposed Contract Action under FAR Part 12 Acquisition of Commercial Items and FAR Part 13 Simplified Acquisition Procedures. This notice is for information only; a solicitation will not be issued. THIS IS NOT A REQUEST FOR QUOTATION. No contract will be awarded on the basis of offers received in response to this notice. The associated North American Industry Classification System (NAICS) code is 335311 with a small business size standard of 750 employees. AFRL requires 40 batteries and installation by certified Eaton technicians for unit one (Eaton 9390 100KVA UPS), part number PWHR12500W4FR and new capacitors and installation by certified Eaton technicians for unit two (Eaton 9390 100KVA UPS), part number AC Cap Replacement. This is for a life cycle replacement for items that are at or near their end of life. The government intends to negotiate a sole source contract with Eaton Corporation c/o Lynn Associates 125 Wolf Road, Albany, NY 12205. The government has determined that there are no authorized third party contractors who can modify our Eaton product by adding equipment other than certified Eaton products or service personnel. Under our existing maintenance contract should there be replacement hardware other than that which is Eaton brand will void the maintenance contract in the event of a failure. If hardware is not installed by certified Eaton factory installers, it will also void the contact if failure occurs. This is a notice of proposed contract action and not a request for competitive quotes; however, all responsible sources may submit a capability statement and/or market pricing, which shall be considered by the agency. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. Responses received will be evaluated; however a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. The Government anticipates an award date on or before 30 September 2015. A Sole Source Justification is attached to this notice.
