- SOW Sole source justification for Nitric oxide. SUBJECT: NITRIC OXIDE GAS PURCHASE ORDER NUMBER: HHSOPC16-000061 SPECIAL NOTICE RESPONSE DATE: September 24, 2015 The National Institute of Health (NIH), Clinical Center (CC), Critical Care Medicine Department (CCMD on behalf of the,Directors's Office, Intend to negotiate with INO Therapeutic on a sole source basis under tge statutory of 41 U.S.C. 253 (c) (1), only one responsible source. to provide nitric gas usage for patients with acute pulmonary hupertension pateints at the Clinical center INO Therapeutic have been working on CCMD since 2010, The Original purchase order for this service expired on September 30, 2015, This firm has the knowledge to continue the amount usage supply of the Nitric oxide gas for crically ill patients in the intensive care unit. Additionally INO Therapeutic is the only company approved in the United States by the Food and Drug Administration (FDA) as a supplier of the Nitric Gas CCMD anticipates negotiating and awarding a firm-fixed-price tupe under this order. The period of performance is 12 months. This notice of intent to award is not a request for competitive quotations. Interested concerns capable of providing the same or similar services as described in this notice may submit a capability statement outlining their capabilities. No solicitation is available. Information received will be evaluated for the purpose of determining whether to conduct a competitive procurement. Capability Statements must be received within the time set forth in this synopsis to be considered by the Government. A determination to compete this proposed contract based on responses to this notice is solely within the discretion of the Government.
