- AMENDMENT NOTICE:This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice.The solicitation number is SGE50015R0139 and is issued as an invitation for bids (IFB), unless otherwise indicated herein.The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-84. Questions not received within a reasonable time prior to close of the solicitation may not be considered.*** For this solicitation, Department of State intends to conduct an online competitive reverse auction to be facilitated by the third-party reverse auction provider, FedBid, Inc. FedBid has developed an online, anonymous, browser based application to conduct the reverse auction. An Offeror may submit a series of pricing bids, which descend in price during the specified period of time for the aforementioned reverse auction. Department of State is taking this action in an effort to improve both vendor access and awareness of requests and the agency's ability to gather multiple, competed, real-time bids.All responsible Offerors that respond to this solicitation MUST submit the pricing portion of their bid using the online exchange located at www.FedBid.com. If this is a ?Brand Name Only? procurement, Seller certifies that it is an authorized distributer of the brand name product being sold to the Department of State and that it has the certification/specialization level required by the manufacturer, to support both the product sale and product pricing, in accordance with applicable manufacturer certification/specialization requirements. Unless otherwise specified, Seller warrants that the products are new and in their original box(es). New Equipment ONLY; NO remanufactured or "gray market" items. All items must be covered by the manufacturer's warranty. Bid MUST be good for 90 calendar days after close of Buy. Shipping shall be either: 1) Cost, Insurance and Freight (C.I.F.) destination to the Seaport in Beirut, Lebanon (see also Buy Terms - Place of Delivery) which means means free of expense to the Government delivered on board the ocean vessel to the specified point of destination, with the cost of transportation and marine insurance paid by the Seller. 2)Free on Board (F.O.B) Destination which means a) Free of expense to the Government, on board the carrier?s conveyance, at a specified delivery point where the consignee?s facility (plant, warehouse, store, lot, or other location to which shipment can be made) is located; and b)Supplies shall be delivered to the destination consignee?s wharf (if destination is a port city and supplies are for export), warehouse unloading platform, or receiving dock, at the expense of the Contractor. The Government shall not be liable for any delivery, storage, demurrage, accessorial, or other charges involved before the actual delivery (or ?constructive placement? as defined in carrier tariffs) of the supplies to the destination, unless such charges are caused by an act or order of the Government acting in its contractual capacity. If rail carrier is used, supplies shall be delivered to the specified unloading platform of the consignee. If motor carrier (including ?piggyback?) is used, supplies shall be delivered to truck tailgate at the unloading platform of the consignee, except when the supplies delivered meet the requirements of Item 568 of the National Motor Freight Classification for ?heavy or bulky freight.? When supplies meeting the requirements of the referenced Item 568 are delivered, unloading (including movement to the tailgate) shall be performed by the consignee, with assistance from the truck driver, if requested. If the contractor uses rail carrier or freight forwarded for less than carload shipments, the contractor shall ensure that the carrier will furnish tailgate delivery, when required, if transfer to truck is required to complete delivery to consignee. The offeror shall select under "Place of Delivery" below the delivery destination of the police training equipment. This solicitation requires registration with the System for Award Management (SAM) prior to award, pursuant to FAR 4.1102 and other applicable regulations and guidelines. Information can be found at www.sam.gov. Registration must be "ACTIVE" at the time of award. The selected Offeror must comply with the following commercial item terms and conditions. FAR 52.212-1, Instructions to Offerors - Commercial, applies to this acquisition. The selected Offeror must submit a completed copy of the provision at 52.212-3, Offeror Representations and Certifications - Commercial Items. FAR 52.212-4, Contract Terms and Conditions - Commercial Items, applies to this acquisition. The following FAR clauses in paragraph (b) of FAR clause 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, will apply: 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.225-13, 52.232-34. The period of Contractor performance for completing the tasks specified below shall not exceed 90 (ninety) calendar days after receipt of the contract/order. The Contractor agrees that the police training equipment furnished under this contract shall be covered by the most favorable manufacturer?s commercial warranty the Contractor gives to any customer for such equipment and that the rights and remedies provided herein are in addition to and do not limit any rights afforded to the Government by any other clause of this contract. The Contractor shall provide a copy in English of the applicable manufacturer?s commercial warranty, with each police training equipment, covered by such a warranty, at no additional cost to the Government. a) Warranty terms: months against any manufacturing defects All equipment shall be delivered to the Seaport in Beirut, Lebanon, within ninety (90) calendar days after award of the contract. The police training equipment shall be delivered either C.I.F. destination basis to the Seaport in Beirut, Lebanon, in accordance with Section II, Sub-Section 22, under FAR 52.247-42, C.I.F. Destination (April 1984),of this solicitation or F.O.B Destination basis to Beirut, Lebanon, in accordance with FAR 52.247-34, F.O.B Destination (November 1991). The offeror shall mark below the delivery destination of the police training equipment: ______Seaport in Beirut, Lebanon. ______ Contractor?s dealership in Beirut, Lebanon. The offeror shall confirm, in the offer, the name and address of the dealership in Beirut.\ ______F.O.B Destination in Beirut, Lebanon. The Contractor shall coordinate delivery of the police training equipment with the following persons: Ms. Jeanine M. Sabaji - INL, American Embassy in Beirut Tel: (++961) 4 - 54 26 00, extension 4570 E-Mail: Sabajijm@state.gov General Fares Fares - Directorate General of the Internal Security Forces (ISF) in Beirut Tel: (++961) 70 - 243 240, E-Mail: ffares-63@hotmail.com The U.S. Government will assist the Contractor in obtaining customs clearance and tax exemption documentation, from the Government of Lebanon, in accordance with Section I, Sub-Section 8, Marking and Submission of Documents, of this solicitation. The inspection and acceptance of the police training equipment shall be performed by the U.S. Government upon their arrival at the Seaport in Beirut. The payment(s) to the Contractor shall be made following satisfactory inspection and acceptance of the equipment, and upon presentation of the certificates of origin to the Office of INL at the American Embassy in Beirut. See SECTION II - CONTRACT CLAUSES of the attached solicitation. The Government will accept partial offers if the seller cannot supply all of the required police training equipment, and reserves the right to make an award to one or more contractors.
