- PUBLIC ANNOUNCEMENT OF INTENT TO AWARD ON A SOLE SOURCE BASIS TO SUNSET DESIGN and PROGRAMMING, INC. Sunset Design and Programming, Inc. will provide programming revisions and development to migrate all NAVFAC Construction Courses posted to the NAVFAC Total Force Training (TFT) site to the Total Workforce Management Services (TWMS) application. Contractor: SUNSET DESIGN and PROGRAMMING, INC., 3217 Ocean Drive Oxnard, CA 93035-4340. The value of the contract is estimated to be $130,611. The Government intends to negotiate directly with Sunset Design and Programming, Inc. No solicitation will be issued. This Notice of Intent is not a request for Expressions of Interest (EOIs), proposals, or quotations. No solicitation document exists and no telephone inquiries will be accepted. No contract award will be made on the basis of EOIs, proposals, or quotations received in response to this notice. However, if any interested party believes they can meet the above requirement, it may submit a statement of capabilities. The statement of capabilities must be submitted in writing and must contain material in sufficient detail to allow the Government to determine if the party can perform the requirement. If parties choose to respond, any cost associated with preparation and submission of data or any other cost incurred in response to this announcement are the sole responsibility of the respondent and will not be reimbursed by the Government. A request for documentation will not be considered as an affirmative response. The Government will be the sole determiner regarding a company ™s ability to meet all requirements. If no responses are received within 3 business days after publication of this notice before 12:00PM EST, to the effect that obtaining services from an alternate source is more advantageous to the Government than obtaining these services through a sole-source contract, then a sole source acquisition award will be made. No questions will be addressed. All responses must be submitted to the Government point of contact at the email address amber.forehand@navy.mil. A determination by the Government not to open the requirement to competition based upon the responses to this notice is solely within the discretion of the Government This purchase will be under Simplified Acquisition Procedures and Other Than Full and Open Competition as authorized under FAR 13.106-1(b). The rationale that only one responsible source, Sunset Design and Programming, Inc., exists is based on: Sunset Design and Programming, Inc. developed the original programming source code using Adobe Flash with ActionScript, and no other contractor is knowledgeable of the location of the working files posted on the NITC servers or how the development and operation of all the working files programming and databases operate.
