Description
15-014186 This is a pre-solicitation non-competitive (notice of intent) synopsis to award a contract without providing for full or open competition (including brand-name). THIS IS A NOTICE OF INTENT, NOT A REQUEST FOR PROPOSAL. A SOLICITATION WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. National Institutes of Health (NIH), Clinical Center (CC), Office of Purchasing and Contracts (OPC), 10 Center Drive, Building 10, Room B1N238, Bethesda, Maryland 20892 intends to negotiate and award on a sole source basis to Philips Healthcare, Division of PENAC, for maintenance and service support for the for Philips Ultrasound IE33 & X7-2t Transducer without providing for full and open competition. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 811219 with a Size Standard of $20.5 Million. PERIOD OF PERFORMANCE This will be a firm fixed price purchase order with 1 year base and 4 one year options period from date of this award. DESCRIPTION OF REQUIREMENT Purpose and Objectives The purpose of this procurement is to get maintenance and service support for the for Philips Ultrasound IE33 & X7-2t Transducer owned by the National Institute of Health, Clinical Center (CC). Project Description The contractor shall provide comprehensive maintenance and service support for the Government-owned Philips Ultrasound IE33 & X7-2t Transducer. The service agreement will require OEM replacement parts, software upgrades and patches, and manufacture recalls for its equipment by a Philips qualified technicians. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted. Specifically, only Philips Healthcare Solutions USA, Inc. is capable of meeting the needs of this requirement due to Philips being the only authorized company to perform maintenance and service on this Philips Ultrasound IE33 & X7-2t Transducer..Philips is the original equipment manufacturer (OEM) and does not authorize third parties to perform maintenance on Philips brand equipment. The intended source is: Philips Healthcare, Division of PENAC, 22100 Bothell Everett Highway, Bothell WA, 90811 CLOSING STATEMENT THIS SYNOPSIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is not a Request for Quote. Sources interested in this requirement must provide a statement of capabilities in sufficient detail to determine if the requirements of this synopsis can be met. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All Offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." Response must be in writing and must be received within seven (7) calendar days from the date of this notice sent to Deborah Culpepper, Contract Specialist, dculpepper@cc.nih.gov. A determination by the Government not to compete the proposed contract based on responses from this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. There is no solicitation package available. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-82 dated March 7, 2015. This acquisition is for a commercial item or service and is conducted under the procedures as prescribed in FAR subpart 12-Acquisition of Commercial Items. This acquisition is not expected to exceed the simplified acquisition threshold.
