Description
JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724 2. Description of Action: The proposed action is for a firm-fixed-price delivery order to be issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC) for GOOD software licenses and associated software maintenance. 3. Description of the Supplies or Services: VA, Office of Information and Technology, Service Delivery and Engineering (SDE), Mobile Technologies requires GOOD software licenses and associated software maintenance. The software licenses and maintenance are required for Government smart phones that provide Federal Information Processing Standard 140-2 protection for data at rest and data in motion. The software maintenance will consist of 24/7 live phone and e-mail support, upgrades, patches and updates to include major releases, point releases, service releases, and security releases of applicable software. The period of performance for this procurement is 12 months with two 12-month option periods. 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized". 5. Rationale Supporting Use of Authority Cited Above: Based on market research, as described in section 8 of this document, it was determined that limited competition is viable among authorized resellers. Only GOOD software licenses and maintenance can meet all of the Government's requirements. VA currently has over 5,000 GOOD licenses deployed within a GOOD infrastructure including two GOOD Control Servers (GMC) in two data centers and numerous GOOD Messaging Servers (GMS) for the actual flow of e-mail. GOOD is the only e-mail solution that is interoperable and compatible with GOOD GMC and GMS. The existing GOOD infrastructure is based on a proprietary code that only communicates with GOOD products. Use of any other license will result in a non-functional e-mail client. In addition, access to GOOD source code is required to issue updates and ensure any services conducted on the GOOD software are properly configured. Adding different e-mail solutions is not economical or practical because it would require the addition of new infrastructure, including standing up new servers and providing significant training to administrators on how to use the new infrastructure. Those administrators would also be required to maintain the current GOOD infrastructure while simultaneously increasing end user support for a different email solution. VA does not have the resources to support multiple e-mail client infrastructures. Conversely, efficiencies are realized through the addition of more GOOD software licenses because VA has already trained staff to use GOOD and a strong security posture is enhanced by reducing the number of infrastructure components VA is required to support, patch and maintain. Based on the market research conducted by the Government's technical experts, it has been determined that no other brand of software licenses and maintenance can meet the Government's requirements. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in section 8 of this justification. Limited competition is anticipated for the required maintenance support. Although the Government is limiting competition, it is anticipated that there will be several authorized resellers of this product on the NASA SEWP V GWAC. In accordance with FAR 5.301 and 16.505(b)(2)(ii)(D), this action will be synopsized and the justification will be made publicly available on the Federal Business Opportunities Page within 14 days of award as the estimated dollar value is over the simplified acquisition threshold. In addition, this Justification for an Exception to Fair Opportunity will be posted on the NASA SEWP V website with the solicitation. 7. Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government will continue to test other products and conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed. 8. Market Research: Market research was conducted by the Government's technical experts in May 2015 to ascertain the ability of any other source, besides GOOD or an authorized reseller, to provide the aforementioned licenses, maintenance and support. The research consisted of reviewing other software applications to include Airwatch inbox and Outlook. Neither of these client software products are interoperable or compatible with the GOOD infrastructure and will not function inside that environment. In addition, as a result of the market research, the technical experts confirmed that as the source code required to issue the updates is proprietary, GOOD is the only source capable of providing the required licenses, maintenance and upgrades for GOOD software within the current infrastructure. While other sources were found that have general capabilities to provide similar services, no other sources were found that could provide the aforementioned services without access to the proprietary GOOD code. No other source has the capability of developing and issuing software updates and fixes for GOOD software necessary to support existing SDE Mobile Technologies requirements. All of the products researched were unable to meet the Government's interoperability, compatibility, and performance requirements that are necessary to integrate with the existing installed software and infrastructure. Additional Market research was conducted in August 2015 through the use of the Provider Lookup Tool on the NASA SEWP V web site. The Provider Lookup Tool yielded a total of 29 SEWP contract holders who are resellers to the GOOD software that can fulfill the Government's requirements. Based on this market research, it is anticipated that there will be limited competition among resellers of this item. NASA SEWP V has a dynamic catalog where line items can be added based on customer requests; therefore, as long as the required item or service is within scope of the NASA SEWP V contracts, items and services can be added to the catalog on a daily basis. This requirement has been found to be within scope of the NASA SEWP V contract in a separate determination. 9. Other Facts: None.
