Maritime Law Enforcement Advisor Manila, Philippines Issuance Date: 06/19/2015 Closing Date: 07/17/2015 SOLICITATION NUMBER: PSC-15-038-INL SUBJECT A solicitation for a Personal Services Contractor (PSC), Department of State (DOS), Bureau for International Narcotics and Law Enforcement Affairs (INL) The United States Government (USG), represented by the DOS, seeks applications from US citizens interested in providing PSC services as described in this solicitation. PRE-AWARD ETHICAL RESPONSIBILITIES OF PSC (JUN 2011) This solicitation may result in the award of one or more personal services contracts as defined in FAR 2.101. Prior to contract award, all offerors or quotes must advise the cognizant Contracting Officer if they have a personal conflict of interest, such as a financial conflict, that would prevent them from either meeting the requirements of the clause entitled, "Post-Award Ethical Responsibilities of Personal Services Contractors," or otherwise objectively performing their contractual duties upon contract award. GS-13 (Equivalent) GENERAL STATEMENT OF THE PURPOSE OF THIS CONTRACT The Office of Afghanistan and Pakistan Affairs (INL/AP) is part of the Bureau of International Narcotics and Law Enforcement Affairs (INL) in the Department of State. The Bureau is responsible for the development, supervision, coordination, and implementation of international criminal justice assistance and international narcotics control assistance activities for the Department of State. INL/AP provides policy guidance and develops, executes, and monitors programs to address the full range of criminal justice issues as they relate to stabilization and reconstruction activities in Afghanistan and Pakistan. The Afghanistan Justice Team focuses on fostering a stable and strong justice system in Afghanistan through support for the Government of the Islamic Republic of Afghanistan (GIRoA) and civil society. To accomplish this goal, the Justice Team manages an array of INL-funded programs in justice sector development, legal training, major crimes, gender justice, legal education, and access to justice sectors. These programs, overseen by INL, are implemented by international organizations, private contractors, and the Government of Afghanistan. In addition, INL has been engaged in efforts with the Ministry of Justice, Attorney General's Office, Ministry of Women's Affairs, Supreme Court, Ministry of Interior, Afghan Independent Bar Association, and Afghan Prosecutors' Association, as well as cross-sector training led by the International Development Law Organization. The INL Afghan Justice Team also collaborates with INL/AP-wide efforts in the corrections and counternarcotics sectors. The Justice Program Advisor (hereafter "Advisor") will advise INL/AP in the management, coordination, and oversight of INL's Justice Sector Support Program (JSSP). JSSP, a Department of State contract currently administered by Pacific Architects and Engineers (PAE), is INL/AP's primary foreign assistance mechanism to GIRoA on justice issues. JSSP partners with the Ministry of Justice, Supreme Court, Attorney General's Office, Ministry of Interior, and the Ministry of Women's Affairs to help the GIRoA achieve effective and professional justice institutions. JSSP helps these justice institutions develop institutional capacity, improves the legislative framework, and implements and expands system integration through a nationwide criminal case management system. Specifically, JSSP advisors working within the Afghan justice ministries advise on topics that include budgeting, procurement, management, report writing, gender equities, ethics, and proposal drafting. JSSP also works with legislative drafters to help reform Afghanistan's legal framework and ensure that laws are clearly drafted, constitutional, and the product of effective and consultative drafting processes. The nationwide criminal Case Management System (CMS) implemented by JSSP contains more than 140,000 unique cases, assists in identifying cases that are over their statutory time limit, and helps ensure a transparent system of criminal processing and adjudication. This initiative represents a critical component of INL's broader mission to bolster the formal justice sector in Afghanistan. The Advisor will manage this important program while also contributing, as requested, to INL's non-JSSP justice assistance activities. DUTIES AND RESPONSIBILITIES 1.Coordinate, manage, implement, and oversee all aspects of one of INL's largest justice programs worldwide, the Justice Sector Support Program. 2.Monitor and advise JSSP leadership in training and advisory support; lead weekly conference calls and participate in monthly program reviews to monitor JSSP progress and provide responsible and effective oversight. 3.Serve as the principal strategic advisor for JSSP, responsible for crafting the program's long-term vision with a particular focus on the ongoing transition. 4.Serve as an advisory resource for INL program managers in Washington and in the field on specific aspects of planning and implementation of ongoing justice assistance programs. 5.Draft Statements of Work and contract modifications and review contractor cost and technical proposals and contract deliverables, to ensure quality oversight and eliminate unnecessary costs and lines of effort. 6.Travel to Afghanistan approximately once per quarter to oversee JSSP's activities on the ground and to attend meetings with key stakeholders, including Embassy Kabul counterparts, Afghan government officials, U.S. military and interagency representatives, nongovernmental organizations, and representatives of foreign governments. 7.Brief INL leadership, Department of State officials, and others as needed on major issues pertaining to Afghanistan's justice system and JSSP's activities, challenges, and achievements. 8.Assist in the coordination and delivery of JSSP's pre-deployment training, including delivering lectures to deploying JSSP advisors on Afghanistan's justice system and INL Justice programs. 9.Assist INL/AP leadership in compiling materials and briefing audit and oversight bodies, congressional committees, and interagency partners. 10.Coordinate and implement the JSSP Performance Management Plan (PMP), an effort to strengthen monitoring and evaluation practices and procedures on the program; work to bolster JSSP metrics to better explain program performance. 11.Work closely with the INL section at Embassy Kabul (INL/K) and Coalition partners to assist in the development and implementation of INL-funded programs in the Afghan justice sector. 12.Define qualification standards and experience levels for various justice positions responsible for mentoring those in the Afghan justice system. 13.Evaluate and reshape the justice assistance program to ensure it meets U.S. foreign policy priorities and objectives, including the ongoing transition. 14.Maintain a thorough knowledge of contracting and budget as it relates to implementing and monitoring justice reform programs in Afghanistan. 15.Prepare background materials and reports used in INL reports, cables, speeches, briefings, and testimony to articulate the Bureau's engagement in Afghan corrections reform efforts. 16.Support INL in outreach activities to increase awareness of INL programs and policies and solicit greater cooperation and participation. 17.Draft responses to requests for information from SIGAR, OIG, and GAO. 18.Assist with recruitment of justice personnel for INL programs. 19.Prepare and deliver training curricula as necessary to support the INL mission. 20.Attend domestic and international conferences on Afghanistan justice reforms. 21.Write reports as required. DELIVERABLES/REPORTS Deliverables are required under this PSC and shall include; monthly status reports, monthly evaluation of contractor performance, special reports when required and "Completion of assignment report," which shall be a compressive review of the projects in which the contractor was involved. Each report shall include a critique of and recommendations for the various projects. The completions of assignment reports are due no later than fifteen (15) days prior to the expiration of this contract. The Personal Service Contractor shall submit one (1) copy of each report as required to the following; INL/Program Officer Per FAR Part 4, the above referenced documents shall be incorporated and copies stored in the PSC's hard file under Section V.; Tab E - Receiving Reports. The Contractor shall prepare and submit two copies of each technical report required by the schedule of this contract (e.g., progress reports, final reports, etc.), to the Embassy INL Section and to the Program Officer, Bureau of International Narcotics and Law Enforcement Affairs (INL), Department of State Washington, DC. The title page of all reports forwarded pursuant to this paragraph shall include a descriptive title, the author's name(s), contract number, project number, and title, contractor's name, name of the State Department project office, and the publication or issuance date of the report. When preparing reports, the Contractor shall refrain from using elaborate artwork, multicolor printing, and expensive paper/binding, unless it is specifically authorized in the Contract Schedule. Wherever possible, pages should be printed on both sides using single spaced type RELATIONSHIPS The Advisor will report directly to the INL/AP Justice Team Lead. The Advisor may also coordinate INL/AP Justice Team activities, if so designated by the INL/AP Director, Deputy Director, or Justice Team Lead. The Advisor is a subject matter expert in the justice field, has intimate knowledge of INL's Afghan justice support programs, engages in inter-agency programmatic coordination, is familiar with internal Embassy and INL/Kabul operations, and engages and advises other members of the INL Justice Team on issues pertaining to administering justice programs in Afghanistan. The Advisor serves multiple roles including: coordinating the transition of critical JSSP elements to the Ministry of Justice, the Attorney General's Office, Ministry of Women's Affairs, the Ministry of Interior, and the Supreme Court, while identifying key components to make these institutions more sustainable: managing all JSSP contractor activities on a daily basis; being the direct interface to INL officials in Washington and Kabul; providing high-level briefings on critical justice sector issues; being responsible for responding to all information and data requests; coordinating multiple ongoing JSSP-related projects; as well as other duties as assigned. The Contracting Officer's Representative (COR) is delegated the authority to act for the Contracting Officer in matters concerning technical clarification, inspection and, after concurrence by the Contracting Officer, acceptance of Contractor performance under the contract, including preparation of receiving reports, and the authorization of progress payments when appropriate. The COR will coordinate all work with the Contractor and review Contractor's performance at significant stages of its development. In no instance, however, shall the COR be authorized to alter or modify the specifications or the contract terms and the conditions or waive the government's requirement, price, delivery, or other terms and conditions. Such changes must be authorized, in writing, to the Contracting Officer. COMPLEXITY The Advisor performs a broad range of tasks related to maintaining strong interagency relationships as well as a complex foreign assistance program. Work involves developing program strategies for management and outreach and execution with multiple agencies and foreign partners at one time. The ability to remain flexible and manage changing needs and schedules is essential. Work involves planning, organizing, analyzing, and managing day-to-day administration and oversight of INL's JSSP; therefore, the ability to effectively manage complex operations and program elements amid a continually changing operating and security environment is essential. SCOPE AND EFFECTIVENESS The Advisor will work closely with U.S. justice administrators, justice professional organizations, INL program managers, U.S. embassies, and foreign government officials. MINIMUM QUALIFICATIONS 1.U.S. Citizenship, with active Department of State Top Secret security clearance. 2.Bachelor's degree in Political Science, Legal Studies, or a related field, from an accredited institution. 3.At least 3 years of relevant overseas experience working in a U.S. Embassy. 4.Work experience issuing guidance related to program development and management of foreign assistance specific to the Afghan justice sector. 5.Demonstrated ability to manage and oversee Rule of Law assistance programs with an annual budget of over $40 million annually. 6.Experience monitoring and overseeing the development and implementation of a nationwide criminal case management system. 7.Experience in strategic planning, policy development, and implementation of major agency-level programs. 8.Knowledge of Federal procurement and contracting regulations. PREFERRED QUALIFICATIONS 1.Demonstrated knowledge of Federal budget process. 2.Demonstrated experience working on international justice reform issues, including working overseas in the Rule of Law development field. 3.Demonstrated ability to work and coordinate with corrections development programs. 4.Experience working in multiple conflict zones. 5.Superior interpersonal and presentation skills. GOVERNMENT-FURNISHED EQUIPMENT: The PSC shall be able to use a furnished with office space, a computer, office telephone, and other supplies needed for job requirements. This property will be owned and maintained by the Department of State DoS. TRAVEL REQUIREMENTS The position is located in Washington, D.C. Frequent domestic travel is required to represent INL at professional conferences and other conferences related to international justice development and reform programs. Likewise, the Advisor shall travel to Afghanistan on a TDY basis approximately once per quarter or additionally as directed by the INL/AP Justice Team Lead and/or INL leadership. The Advisor is required to spend at least 10 days per year in training as approved by the INL/AP Justice Team Lead and the INL/AP Deputy Director; training may occur at the Foreign Service Institute (FSI) or though other venues as approved by INL. EVALUATION CRITERIA Factor 1:Experience (30 points) Program management or advisory experience on justice development initiatives in Afghanistan with a particular emphasis on the ability to coordinate effectively among diverse and competing stakeholders. Demonstrated ability to work on and bear responsibility for several simultaneous projects while keeping the overall program goals in perspective. Demonstrated ability to interact effectively with a range of U.S. and foreign national personnel at all levels of an organization. Demonstrated experience working with international organizations, problems, and other aspects of foreign affairs. Factor 2:Strategic Thinking and Problem Solving (30 points) Demonstrated ability to apply critical thinking to complex problems. Demonstrated initiative, well-developed problem-solving skills, and flexibility, receptivity, and creativity dealing with problems and conflicts. Factor 3:Knowledge of Afghan Justice System (30 points) Extensive knowledge of the Afghan justice system. Knowledge of INL Rule of Law programming. Factor 4:Past Performance (10 points) Past Performance evaluation of applicant's ability to perform under contract. (In conducting the evaluation, the Government reserves the right to utilize all evaluation information available at the time of evaluation, whether provided by the applicant or obtained from other sources.) COMPENSATION (BASE PAY) For award, INL will negotiate for this contract based on the market value as outlined above and overall experience relevant to the solicitation requirements.
