- The U.S. Department of Agriculture (USDA), Food and Nutrition Service (FNS) intends to award a non-competitive limited source purchase order to INTELLIGENT ENTERPRISE SOLUTIONS, LLC., 6901 ROCKLEDGE DRIVE, SUITE 600, P.O. BOX 34076, BATHESDA, MD 20827-0076, for renewal of subscription for ACL software. This is confirming that AQ is the sole authorized distributor of the AQ Software in North America and the exclusive provider of AQ certified technical support services for the Software in North America and that no third parties are authorized to provide AQ certified technical support services for the Software in North America. ACL Servlcm Ltd. CACLi - ACL Certtfted Servlcm •Training It is confirmed that ACL Services Ltd. of 1550 Albeml Street, Vancouver, British Columbia, Canada, V6G 1A5 Is the sole manufacturer and sole supplier of ACL Software and Certified Services (Including Training) In the United States and Canada and that intelligent Enterprise Solutions of 6901 Rockledge Drive, Suite 600, PO Box 24076,Bethesda MD,20827-0076 United States, is the sole source OPEN MARKET ACL Software and Certified Services (including training). The statutory authority permitting Other than Full and Open Competition is 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1. Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. This procurement is in accordance with Part 12 and Part 13 procedures. The North American Industrial Classification System (NAICS) code for this procurement is 423430. This notice of intent is not a request for proposals or quotations and a solicitation will not be issued for this requirement. Any responses or inquiries to this notice must demonstrate clear and convincing evidence that competition will be advantageous to the Government. The Government will not pay for information submitted. A determination by the Government not to compete this procurement action, based on responses to this notice, is solely within the discretion of the Government. Responses to this notice are due by 11am EST Tuesday, September 29, 2015.
