Attachment A, Sample RFQs COMBINED SYNOPSIS/SOLICITATION: LCISS20160004 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, in conjuction with FAR Parts 13 and 16, and additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. Solicitation LCISS20160004 is issued as a Request for Quotes (RFQ) CUSTOMS BROKER SERVICES and constitutes the only solicitation, a written solicitation will not be issued. This RFQ and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-85. As a legislative branch agency, statutory requirements relating to small business concerns do not apply. The Library of Congress lacks the authority to set-aside procurements. This RFQ will be conducted using full and open competition under NAICS 488510. CLIN - Description - Quantity - Minimum Quantity - Maximum Quantity 0001 - Customs Brokerage, Base - $500 - $25,000 1001 - Customs Brokerage, Option 1 - $500 - $25,000 2001 - Customs Brokerage, Option 2 - $500 - $25,000 3001 - Customs Brokerage, Option 3 - $500 - $25,000 4001 - Customs Brokerage, Option 4 - $500 - $24,999 The Library of Congress has a requirement for Customs Brokers/ Customs Clearance Services; see http://www.cbp.gov/trade/broker for Customs Broker description and responsibilities. Unknown types of property of arrive at unknown times to unknown locations throughout the continental U.S. As a result of this RFQ, a Multiple Award Indefinite Delivery / Indefinite Quantity (IDIQ) Contract will be awarded to the three (3) responsible businesses whose quotations conform to the requirements of this RFQ and offer the "best value" to the Government. The Government will purchase a 1 year Continuous Bond from each of the (3) Awardees, with an Option to extend the contract and purchase another Continuous Bond annually. When Customs Broker Services are required, the Government will request quotations from all the bond holders (Awardees) for customs clearance. Each Awardee shall provide a quote within 24 hours. TASK ORDERS will be issued to the bond holder whose quotation offers the lowest price with acceptable delivery terms as determined by the Contracting Officer's Ordering Representative. Upon request, the Contracting Officer will make their full text available. The offeror is cautioned that the listed provisions may include blocks that must be completed by the offeror and submitted with its quotation or offer. In lieu of submitting the full text of those provisions, the offeror may identify the provision by paragraph identifier and provide the appropriate information with its quotation or offer. Also, the full text of a solicitation provision may be accessed electronically at these addresses: http://farsite.hill.af.mil/ and https://www.acquisition.gov/. 52.212-1, Instructions to Offerors-Commercial (Apr 2014). In conjunction with the requirements of FAR 52.212-1, the following instructions are specific to this solicitation: 1. This solicitation for an IDIQ contract requires Offerors to provide SAMPLE pricing by completing Attachment A, SAMPLE RFQ. The Contractor shall submit the completed Attachment A in PDF format with their Quotation. Their quotation should contain the Base Plus Four Option Years Total Price for each example, as well as the Grand Total for all examples. 2. The Offeror shall provide proof of active Customs Broker License from the U.S. Customs and Border Protection in PDF format with their Quotation. EVALUATION ADDENDUM (In lieu of 52.212-2). The Government will award three (3) IDIQ contracts resulting from this solicitation to the responsible offerors whose quotes conform to the solicitation and will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: FACTOR 1: Price. Completed Attachment A, SAMPLE RFQ will be used to compare Offerors commercial pricing. FACTOR 2: Active Customs Broker License from the U.S. Customs and Border Protection. This definitive requirement is necessary for the conduct and performance of this contract. FACTOR 3: Past Performance. The Library will review records contained in the Past Performance Information Retrieval System (PPIRS) for adverse past performance. The Library reserves the right to use other sources. The Offeror will be evaluated neither favorably nor unfavorably on past performance if no relevant information on past performance is provided by the offeror or obtained by the Library. OPTIONS. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the options. (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. 52.212-3, Offeror Representations and Certifications-Commercial Items, The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site accessed through http://www.acquisition.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (p) of this provision. 52.217-5, Evaluation of Options (Jul 1990). The Contractor may submit payment requests using other than electronic means only when alternate procedures are authorized by the Contracting Officer in writing. LC52.201-1 CONTRACTING OFFICER'S REPRESENTATIVE (COR) APPOINTMENT AND AUTHORITY (Dec 2013) (a) Performance of work under this contract is subject to the technical direction of the COR. The term "technical direction" includes, without limitation, direction to the contractor that directs or redirects the labor effort, shifts the work between work areas or locations, and/or fills in details and otherwise serves to ensure that tasks outlined in the contract are accomplished satisfactorily. (b) Technical direction must be within the scope of the contract specification(s)/work statement. The COR does not have authority to issue technical direction that: (1) Constitutes additional work outside the contract specification(s)/work statement; (2) Constitutes a change as defined in the "Changes" clause of this contract; (3) Causes an increase or decrease in the contract price, or the time required for contract performance; (4) Changes any of the terms, conditions, or specification(s)/work statement of the contract; (5) Interferes with the contractor's right to perform under the terms and conditions of the contract; or (6) Directs, supervises or otherwise controls the actions of the contractor's employees. (c) Technical direction may be oral or in writing. The COR must confirm oral direction in writing within five workdays, with a copy to the Contracting Officer. (d) The Contractor shall proceed promptly with performance resulting from the technical direction issued by the COR. If, in the opinion of the contractor, any direction of the COR or the designated representative falls within the limitations of (c) above, the contractor shall immediately notify the Contracting Officer no later than the beginning of the next Government work day. (e) Failure of the Contractor and the Contracting Officer to agree that technical direction is within the scope of the contract shall be subject to the terms of the "Disputes" clause of this contract. LC52.201-2 ORDERING OFFICERS (OCT 2013) (a) Contracting officer's ordering representatives, "Ordering Officers," specifically designated for this contract are authorized to place delivery or task orders (or calls under Blanket Purchase Agreements) expressly within the terms and conditions of this contract. (b) Specifically, Ordering Officers may not: (1) Make any changes to the terms or conditions of the contract or order (2) Issue modifications to orders, administrative or otherwise (3) Order or accept supplies or services not expressly within the scope of the contract; (4) Issue instructions to the contractor to stop or start work, or perform work that is outside the scope of the contract; (5) Authorize delivery or disposition of Government property not authorized by the contract; or (6) Re-delegate Ordering Officer authority. (c) The Library is not obligated to pay for orders for products or services not included within the scope of this contract and clause. (d) The following Government employees are designated contracting officer's ordering representatives under this contract: To be provided with award. LC52.203-1 CONTRACTOR PUBLICITY (OCT 2013) The Contractor, or any entity or representative acting on behalf of the Contractor, may not refer to the equipment or services furnished pursuant to the provisions of this contract in any news release or commercial advertising, or in connection with any news release or commercial advertising, without first obtaining explicit written consent to do so from the Contracting Officer. Should any reference to such equipment or services appear in any news release or commercial advertising issued by or on behalf of the Contractor without the required consent, the Government will consider institution of all remedies available under applicable law. LC52.216-2 ORDER PLACEMENT - MULTIPLE AWARD INDEFINITE DELIVERY INDEFINITE QUANTITY (FEB 2015) Task Orders will be issued by the Contracting Officer and may be mailed, e-mailed, faxed, or issued orally. In most cases, the Library may send a Statement of Work, any instructions, and evaluation factors as applicable to the individual task order competitions. In accordance with FAR 16.505(b)(1) - Fair Opportunity, all contractors will be provided a Fair Opportunity to be selected for award of each task order under this contract unless an exception applies. The Contracting Officer will issue a notice of opportunity and request for task order proposal describing the required goods or services and requesting information to support evaluation and selection of an order awardee. Contractors will have 24 hours to submit a proposal. The Library may award a task order based or conduct technical and/or price negotiations if necessary. While the Library reserves the right to unilaterally issue orders for work identified in this contract, the Library will generally solicit task order proposals and issue task orders bi-laterally, in which case the signature of the vendor and the Contracting Officer are necessary for full execution of each task order. All Task Orders are subject to the terms and conditions of this contract. In the event of a conflict between a Task Order and this contract, the contract shall control. The contractor shall not accept task orders which exceed the "not-to-exceed" amount of the contract or which are placed after the end of the contract ordering period. The Librarian has designated the Office of General Council (OGC) as Competition Advocate and the Task and Delivery Order Ombudsman. Ombudsman contact information: To be provided with award.
