- Presolicitation Document FEDERAL BUSINESS OPPORTUNITY (FBO) NOTICE Non Nuclear Modifications, Outage and Supplemental Maintenance Support Alliance Contract Tennessee Valley Authority (TVA) intends to purchase the following goods and services by Competitive Negotiation: In the near future, TVA intends to issue a Request For Proposals (RFP) for a long-term (5 years, with option to extend) agreement to conduct modifications, outage and supplemental maintenance work at TVA's coal and hydro generating plants, and possibly work at other TVA owner and/or controlled facilities. CONTRACTOR's principal work shall be to employ and manage all supervisory and craft labor necessary for the execution of: •· modifications, outage and supplemental maintenance work •· construction, rehabilitation, modifications, removals, replacements •· asbestos abatement (direct or through subcontractors) •· insulation and lagging (direct or through subcontractors) •· protective coatings (direct or through subcontractors) •· construction testing of components and/or systems identified by TVA at generating plants and other sites located within the Tennessee Valley region. In connection with this work, CONTRACTOR will perform a variety of functions, including but not limited to: •· administration and enforcement of a safety program meeting OSHA and TVA standards •· site/field engineering •· project management functions (which includes, but not limited to supervision, project controls, scheduling, estimating, budget controls, forecasting, etc.) •· quality control functions including plans, inspection and testing services •· training (craft and non craft) •· administration of CONTRACTOR subcontractors and TVA's contractors as assigned •· possible procurement related activities (as authorized for materials and equipment approval by TVA) •· utilization of existing programs in place at TVA, such as computer based project controls software compatible with current TVA utilized software, including but not limited to Primavera and Microsoft Office. TVA intends that any resulting contract would address various methods of pricing based on the best option for the project. Exclusions: CONTRACTOR will not: perform any design engineering services. directly perform turbine generator work. directly perform work not covered under the Project Maintenance & Modifications Labor Agreements (PMMA) such as roofing, paving, fencing, elevator repairs. provide technical services of the sort that TVA normally obtains from boiler manufacturers. CONTRACTOR may be required to furnish to TVA, under TVA's supervision, augmented personnel for project support work associated with: Turbine generator work TVA's Power Service Shop Short term staffing for projects to address temporary peaks, gaps or specialized needs As requested by TVA to meet business objectives TVA desires to select one or more firm(s) with a history of successful experience in generating plant modifications, outage and supplemental maintenance work, but will entertain proposals from joint ventures or other teaming arrangements of firms which have such experience. The following is a brief summary of the magnitude of potential work. 1. Non-Nuclear - Managed Task CONTRACTOR agrees to provide the services of qualified personnel (craft and non craft) to perform outage, modifications, supplemental maintenance services, and technical support (excluding design engineering services) services at TVA's 9 Coal Plants (39 active Units), 29 Conventional Hydro generating plants (109 units), 20 non-power dams, one Pumped Storage facility, Power Service Shops (located in Muscle Shoals, AL), and other sites located within the TVA region. CONTRACTOR may also provide maintenance, project and outage work for TVA's Gas Fleet comprised of 6 combined cycle plants (12 active units), 9 Simple Cycle Plants (87 active Units). During a typical outage season: •· Coal can have 6 - 10 units in outage at possibly 3 - 6 different locations with some site locations having multiple unit outages starting on or close to the same dates •· Hydro can have 10 - 18 outages at the same time as coal located throughout the Tennessee Valley. Of the units in outage, 2 - 3 coal outages could start on the same date with the other outages having staggered starting dates. An example of a typical forecasted outage schedule will be provided with the RFP. Due to the age of the TVA facilities, asbestos abatement may be required for authorized work. The asbestos abatement work is included in this proposal and can be performed direct or through the use of subcontractors. All craft labor will be obtained through union hall referral process. Although no minimum amount of Work will be guaranteed, the estimated annual managed task labor man hours for a fiscal year could be as many as the following once CONTRACTOR's work is fully implemented: Coal - up to 2,000,000 Hydro - up to 300,000Power Service Shop (Shop II) - up to 50,000 Gas Fleet - up to 500,000 2. Protective Coatings - Managed Task TVA desires the CONTRACTOR to provide Protective Coatings work across the valley. Some Protective Coatings work may be performed in conjunction with planned unit outages. Application of all types of protective coatings are required. Protective Coatings projects involve: •· sandblasting, power tool cleaning, or other methods as specified by TVA, including lead abatement. •· steel repairs are required when corrosion is excessive, and contractor will have to staff and perform this corrective work. The Protective Coatings work can be direct or through a subcontractor. The protective Coatings projects generally have the largest crews during the spring, summer and fall months. Multi year projects usually will work the entire year including the winter months. Although no minimum amount of Work will be guaranteed, the estimated annual managed task man hours for this work for a fiscal year is up to 125,000. Augmentation Offeror agrees to provide, as requested by TVA, augmented personnel (predominantly craft) under the direct supervision of TVA. Although no minimum amount of Work will be guaranteed, the estimated annual augmentation labor man hours for a fiscal year could be as many as the following once CONTRACTOR's work is fully implemented: Fossil Plant Non nuclear Support : up to between 300,000 - 500,000 Power Service Shops Support: up to between 550,000 - 650,000 Other non-nuclear organizations: up to between 500,000 - 600,000 TVA seeks Respondents that have demonstrated the ability to manage and execute the magnitude of potential work associated with this scope of work. Prior to issuing the RFP to the interested bidders, TVA will require all interested bidders to certify that they meet or exceed the mandatory minimum requirements shown below. All interested bidders are required to supply a certification to TVA no later than 20 days after date of FBO publication. The following are the mandatory minimum qualifications which Offeror(s) must meet in order to be invited to submit proposals and be considered for award of the proposed contract. Offerors are required to submit detailed supporting documentation to substantiate meeting all mandatory minimum qualification requirements prior to receiving a formal RFP. The minimum qualifications are as follows: MINIMUM QUALIFICATIONS AREA CRITERIA Safety Offeror must have an acceptable safety program with a current EMR no greater than 1.0 Offeror must have an OSHA RIR < 1.0 for the years 2011 - 2015 (August) or average < 1.0 for the years 2011 - 2015 (August). Offeror must have an acceptable safety program with a demonstrated ability to assign onsite safety professionals. Offeror agrees to submit proof of safety records for the years 2011 - 2015 (August) for review by TVA. Offeror will provide safety information concerning any open, pending or closed citations / violations - state, federal, criminal or enforcement for years 2011 - 2015 (August). Offeror has no safety claims or litigation and / or any other claims or litigation which, in the Offeror's good faith best judgment may adversely impact its ability to perform the contract. Offeror must be or become a member of ISNetworld ( www.ISNetworld.com ) at Offeror's sole cost. Offeror also must update its information in ISNetworld after submitting its proposal, and prior to any contract award date. Offeror must provide history of safety performance for any TVA projects performed (direct or through subcontracts) in the last 5 years (includes project name, man hours worked, recordable incident rate, lost time rate and workers compensation rate) Environment Offeror or Offerors subcontractor must have current asbestos abatement licenses or the ability to obtain asbestos abatement licenses for Alabama, Tennessee, Kentucky, North Carolina, Georgia, Virginia and Mississippi. Offeror or Offerors subcontractor will provide environmental information concerning any open, pending or closed citations / violations - state, federal, criminal or enforcement for years 2011 - 2015 (August). Offeror or Offerors subcontractor has no environmental claims or litigation and / or any other claims or litigation which, in the Offeror's good faith best judgment may adversely impact its ability to perform the contract. Offeror must provide history of environmental performance for any TVA projects performed (direct or through subcontracts) in the last 5 years (includes project name, type of event, type of violation - Notice of Violations, Recordable Environmental Event, as defined by state or federal regulations) Labor Offeror must be willing to become signatory to TVA's labor agreements. Offeror has a demonstrated history of direct hire and managing a union labor workforce. Experience Offeror shall have successfully completed at least five (5) outage and modifications projects at a coal electrical generation plant in North America since January 1, 2010. Excluded from this requirement is work associated with the installation and tie in of TVA's or other utilities Environmental and Clean Air Strategy Projects. Projects submitted must have been completed with the contractor directly employing and managing almost all craft labor being obtained through union referral. Offeror must show proof of working multiple outages at different site locations within the same time periods (multiple projects during a fall or spring outage season). Continuing services provided on a long term basis at multiple sites with multiple work released will not be considered in the whole with regard to project magnitude. This experience must be met by the Offeror and not through the experiences of others (no pass through). At least 2 of the projects are to be primarily coal power boiler related projects. In addition to the above, Offeror must be able to show: 1. Demonstrated boiler expertise to perform field installation and modifications work for major coal boiler outages plus auxiliary equipment maintenance. 2. The craft labor and supervision of one (1) of the modifications projects is to have been completed in an outage and is to be greater than 140,000 man hours. 3. The craft and supervision for each of the remaining four (4) projects is individually to be greater than 35,000 man hours. Offeror will perform work at TVA hydro facilities and the TVA gas fleet across the valley. This will include an additional volume of hydro work estimated to be up to 300,000 man hours and gas work estimated to be up to 500,000 man hours. Offeror will be required to provide proof of successful project completion for hydro plant work and gas plant work.. Offeror shall have successfully completed (direct or through subcontract) coatings project work in the last five (5) years that involves sandblasting, power tool cleaning or other methods as specified by TVA including lead abatement. Must demonstrate direct hire work for projects such as gates (lock miter, radial and leaf spillway), transformer coatings, penstock, etc. and coal conveyor steel, ductwork and sidings. Offeror must have experience in the Microsoft Office software package and be able to run systems and data in the Windows® (Windows is a registered trademark of Microsoft Corporation in the United States and other countries). Offeror has experience in computer based project control systems, such as Primavera (P6), and agrees to utilize TVA project control system for TVA work or provide an electronic system that meets TVA needs. Quality Offeror shall have a valid ASME "R" stamp. Financial Offeror must have the financial capability (credit worthiness) to obtain a payment / performance bond to cover the estimated volume of work submitted in the proposal. Offeror must have an A.M. Best Credit rating of at least A-. Offeror agrees to TVA's Right to audit - upon reasonable notice, TVA, its agents, or the United States General Accounting Office shall have the right to audit without restrictions and at no additional cost to TVA, at any time during normal working hours, the items and costs billed under this contract including and without limitation, all fees and direct and indirect costs incurred by CONTRACTOR and billed to TVA, including billings to verify the rates and costs billed to TVA hereunder as represented by Contractor. Offeror agrees to no markups on TVA supplied / owned items, such as tools, materials, heavy equipment, etc. Offeror agrees to no markups on craft labor for cost reimbursable projects. Supplier Code of Conduct TVA is entrusted with use of public resources to perform a mission of public service, and must conduct all of its activities with a high level of integrity to maintain public confidence. TVA's Suppliers/Contractors must share this TVA commitment to integrity. TVA's Supplier Code of Conduct applies to all individuals and organizations that supply services or materials to TVA, including managed task contractors, consultants, staff augmentation contractors, and vendors and their employees, agents, and subcontractors. Suppliers/Contractors are expected to educate all of their representatives involved in business with TVA to ensure they understand and comply with TVA's Supplier Code of Conduct, a copy of which is available on TVA's Supply Chain Internet Site at http://supplier.tva.gov Note: If the Offeror believes a valid exception to any of the mandatory minimum requirements exists, please submit the certification with a detailed explanation of the exception. TVA will review the exception and make a determination of its acceptability. No challenges will be accepted to TVA's decision.
